Hi All,
Welwyn Hatfield Council, Code 63 parked with one wheel on or
over a footpath, Maverick Gym Burrowfield
On Sunday Morning, I parked near my local gym to use their
facilities (on an industrial site, not a residential area).
After finishing my session, I returned to see I received a PCN,
As you can see in the image attached, my issue is that the sign
is not clearly visible unlike the other nearby areas which have
a ‘do not park on a verge at any time' sign.
This area historically has not been a ‘no parking area’ as I
have used this gym since it opened in November 2023.

No signs = no contravention, (except in London where it's in
legislation as not needing signs or lines). I see no signs
either on your posted photo, or GSV.

This is a new restriction that was introduced - along with a
Resident Parking Zone - on Monday 3rd March 2025. The TRO has
yet to make it onto the TPT website, but can be found here.

Thank you both for the input - I believe the sign is attached to
the lamp post (albeit facing the metal fencing).
Is that an issue worth appealing for?

I've had a look at the CEO's photos, and rather disingenuously,
the photo of the sign is on the pole by this building, which is
a distance away, and more importantly, on the other side of the
road, so it doesn't apply to the side you parked on.

(there's no sign on the GSV view because it is before the
restrictions started, but the streetlight pole is there)
You are correct that the sign on your side seems to be turned
away, but that is their own stupid fault in not regularly
maintaining their signage. You only know this because you got
the PCN. The CEO should have reported the turned-away sign,
and not served you with a PCN.
This is pretty typical of dozy councils like this one. But
despite being doze the money rolls in because most people
getting a PCN, just cough-up to get the discount option.
You should win this at adjudication.

Do you think I could successfully appeal with this email:

"To Whom This May Concern,
I am writing to challenge PCN WW3434433344 issued on 27/4/2025
at Burrowfield, Welwyn Garden City.
I respectfully submit that the PCN should be canceled on the
following grounds:
Inadequate and unclear signage:
At the location where I parked, there were no clear, visible
signs indicating that parking on the verge or footpath was
prohibited. Nearby areas have clear "Do not park on the verge at
any time" signs, but these were not present, visible, or
applicable to the spot where my vehicle was parked. I have
attached photographic evidence showing the absence of clear
signage.
Historic use of the area:
I have used the gym at this site since its opening in November
2023 and, like other visitors, have parked similarly without
incident. This further supports the lack of clear communication
regarding any prohibition.
Footway parking outside London:
As this contravention occurred outside London, I understand that
footway parking prohibitions require a valid Traffic Regulation
Order and adequate signage to be enforceable. In the absence of
clear signage at the location, the contravention is not
adequately established.
On this basis, I respectfully request the cancellation of this
PCN.
Thank you for your time and consideration.
I look forward to your positive response."

I think I would also add that the CEO photo of the sign is 57
metres away from where you parked and on the opposite side of
the road. This means this sign does not apply to the location
where parked.

I'm sure a photo of this sign is on their website record for the
PCN so I had another look. Your PCN Number you've typed is
wrong, too many characters. It actually is : WW34433344 and
there is a CEO photo of the sign the evidence record.
