So yesterday I received a new letter from DCB legal informing me
that their client intends to proceed with the claim, that the
court will direct both parties to file directions questionnaires
and in anticipation of this, they enclose a copy. They suggest I
call them to discuss settlement. I assume this is another scare
tactic but what's your advice?

Do not call them, ever, and in due course hang up on them and
block their number if they try to call you.
Everything in writing. No exceptions.

The court will send you your own Directions Questionnaire to
complete and return, but you should do it online, this is where
you state your local court and your requirement to have the case
heard in person at your local court. Look around for
instructions which are here a-plenty. No hurry.
Post any other paperwork received, please, the claimants DQ for
example.

No, but don’t ever call them as I said. I didn’t say ignore.
You will in due course need to respond to their formal Letter of
Claim, you will get advice here when you do.
(I’m behind the process, this has already happened)
Have you submitted the defence above? It seems a long time since
you were originally contacted by the court.

You do not negotiate with DCB Legal. Refuse any offers to
settle. They will eventually discontinue if the claim isn't
struck out first.
Having received your own N180 (make sure it is not simply a copy
of the claimants N180), do not use the paper form. Ignore all
the other forms that came with it. you can discard those.
Download your own here and fill it in on your computer. You sign
it by simply typing your full name in the signature box.

Here are the answers to some of the less obvious questions:
[indent]• The name of the court is "Civil National Business
Centre".
• To be completed by "Your full name" and you are the
"Defendant".
• C1: "YES"
• D1: "NO". Reason: "I wish to question the Claimant about their
evidence at a hearing in person and to expose omissions and any
misleading or incorrect evidence or assertions.
Given the Claimant is a firm who complete cut & paste parking
case paperwork for a living, having this case heard solely on
papers would appear to put the Claimant at an unfair advantage,
especially as they would no doubt prefer the Defendant not to
have the opportunity to expose the issues in the Claimants
template submissions or speak as the only true witness to events
in question.."
• F1: Whichever is your nearest county court. Use this to find
it:

• Sign the form by simply typing your full name for the

When you have completed the form, attach it to a single email
addressed to both dq.cnbc@justice.gov.uk and info@dcblegal.co.uk
and CC in yourself. Make sure that the claim number is in the
subject field of the email.

Many thanks both - and apologies for my slow reply - I didn't
see the follow up messages that came in after the first replies
due to the notification system.
[member=636]jfollows[/member] - yes I did submit the defence
claim and strikeout order - following b789's instructions -
sent on 28th April.
I have now received by post a Notice of Proposed Allocation to
the Small Claims Track & N180 questionnaire . The cover letter
sent 18th June - states that 'The defendant has filed a defence'
- but the words 'a copy of which is enclosed' have been scrawled
out.
I have downloaded the online N180 and completed it using
[member=26]b789[/member]'s wording for D1. I have until 7th
July to submit but will do so now. Many thanks for the
excellent instructions.

Just keep following the advice. The "cover letter" is sent to
both parties. In your case, you don't need a copy of the defence
because you are the defendant.

I have now received a Mediation Appointment Confirmation email.
It will be a telephone call on the morning of 11/08/2025
I assume you have seen these before but I can post the contents
if useful.
Would love to have guidance on what I should say in my defence.

You speak to a mediator, who is not legally trained, and do not
get drawn into discussing your defence. If the mediator tries to
talk about it, make a formal complaint after the session. You
offer £0 to settle, that’s it, the call will be over and various
people can tick boxes.
So you do not say anything in your defence. This is not the
time.
