Waltham Forest 01 Parked in a restricted street during
prescribed hours, Hooker's Road

On the evening of 4th April, a relative came to visit us and
parked in Hooker's Road (on double yellow lines, outside of a
marked bay - see photos below, link:

When they returned
to their vehicle they found they had been issued a PCN at
9:03pm, with the violation code stated as "01 Parked in a
restricted street during prescribed hours".
At first glance this seems like an incorrect violation code -
the prescribed hours that restrictions are in place is 8am -
6:30pm, Mon - Sat (permit holders only). There is no mention of
being parked outside of the bay.
One thing to note though is that all of the signs have been
spray painted over in red (see photo below) - I'm not sure what
the purpose of this was. Could this be an attempt to invalidate
the timings of the restrictions so that they apply 24/7, or
simply vandalism? If anything it makes it less clear what the
restrictions actually are.

Surely your relative knows that double yellow lines apply 24/7?
Were they aware they were on double yellows, and how long for?
The contravention wording is standard for yellow lines.

I can ask them, but would that actually constitute a defence if
they were somehow unaware? (e.g.. if the lines were not clearly
marked - though photos suggest this is not the case).

Fair enough - it seemed an odd contravention code to me at first
glance. But then I've not exactly "been round the block".

Clear double-yellow lines in 2022, the latest GSV view, and the
photos confirm they are still there. I don't know where your
relative lives, but certainly in London the streets are
patrolled 24x7 by CEOs and parking for any length of time on
DYLs is just asking for a PCN. Ignorance of what they mean is
not a defence. Also note that no signs are needed, the lines are
enough on their own. It is certainly true that in the provinces
one could well get away with parking on DYLs in certain
locations, but there is always the risk even there of parking at
the time the CEO comes around for his daily patrol.
Certainly I cannot see any credible appeal argument, but there
may be a technical appeal based on Waltham Forest mismanagement
of the enforcement process. Councils must obey the law and
regulations as well as the motorist. So wait a bit to see if
anybody suggests anything, but if you're minded to pay the
discount, don't miss the deadline for that.
