       Second hand car, where do I stand

       I bought a s/h Skoda Superb from a dealer near Manchester (I'm
       in London) it cost me around £15000.  It had 67000 miles on the
       clock and looked to be in very good condition.  It had a brand
       new MOT
       I drove it home and it was fine, I didn't drive it much, but a
       couple of weeks later the DPF warning light came on.
       I called the dealer who asked me if I was a member of the RAC
       which I was and was told to call them out which I did.
       The RAC carried out a 'regen' which appeared to work.
       A couple of weeks later having only driven a few miles since the
       regen, My wife and I drove to Harrogate.  After around 100 miles
       the DPF light came on.  i had business in York, Preston and Bury
       before driving home
       This time I called the dealer who said I should take it to a
       Skoda dealer.  (They said they would pay and I have that in
       writing)
       The report that I got back from Skoda was shocking.
       The DPF light couud be caused by either a faulty emissions valve
       and/or a blocked DPF.
       BUT
       They also reported a leaky shock absorber and very worn front
       brakes and disks.
       The car has now done approx 1000 miles since I bought it 6 weeks
       ago.
       200 miles bringing it home, a couple of hundred running around
       locally and 500 miles for my trip up north.
       I expect to hear from the dealer on Monday or Tuesday.
       I want to return the car for a full refund and have told the
       dealer this as I consider it unfit for purpose.
       How do I stand legally?  I paid the deposit by credit card.

       "Leaking" or "misting"?
       I had a "misting of oil on a shock absorber" on the first MOT
       after owning my car, and it has never been mentioned again.
       Either the oil has run out, or it wasn't a misting of oil...
       How long had you owned it when you first reported the fault?
       If within 30 days, in theory, you have the right to reject as
       its faulty. But at 6 weeks now... you appear to be outside of
       that window.
       If more than 30 days and up to 6 months, you have to give the
       dealer one chance to repair/replace/refund (their discretion),
       the onus is on them to prove the fault was not present at time
       of purchase.
       Depending upon the year of car, you may find that the car has
       had less services than you would expect. These are solid cars
       (again, depending on age) if well looked after, and if you do
       the appropriate miles for a diesel to do its regens you should
       have no issues once these are all solved.

       I first reported the problem just before the 30 days was up.  I
       wish I'd gone to Skoda first, not called the RAC.  Skoda say the
       shock absorber is leaking.

       I’ve now returned the car to the dealer for a full refund.
