Hi all,
Today in the post I received a notice to keeper letter informing
me that in the 07/02/2025 a PCN was served to myself.
Reason for ticket:
No ticket displayed
Location:
Dorning street, Wigan
Date issued:
07/02/2025 11:38:22
The letter says the parking charge was affixed to my windscreen
(it wasn't)
The letter says "At the time the charge was Incurred, a notice
to driver was affixed to the vehicle. The notice provided the
opportunity of appeal to the driver within 21 days from the date
of the charge being issued, The opportunity to appeal this
charge has now lapsed"
I have two main issues with this PCN.
Firstly today is the first day I've heard of this PCN so how am
I meant to appeal it.
However the main issue is I did pay and it's a no ticket car
park. I've used it many times and when you pay at the machine it
says there's no need for a ticket, would you like a receipt?
So TLDR I got a ticket for not displaying a ticket in a ticket
less-car park? And never even had a PCN on my vehicle that day.

This is one of the most laughably inadequate NtKs I've ever
seen. Weirdly they don't seem to claim in the NtK or even on
their website to be a member of either the BPA or IPC (which I
think means they shouldn't be able to get your data from the
DVLA) but they are listed on the IPC website as an approved
operator.
Regardless, the NtK is not PoFA compliant - so they cannot
transfer liability to you as the keeper, and you have no
obligation to name the driver.
Obviously it's also ludicrous to state an offence of 'No ticket
displayed' if it's a no ticket car park.
I assume you've typed the PCN number and your VRM into the
website to see if it will let you appeal? Would also be
interested in whether there are any photos (and whether the
windscreen ticket is shown).
Assuming you can't appeal through the site, I'd be inclined to
appeal to their info@ or by post with proof of postage, for the
sake of having done something if it ever went to court (using
the standard wording repeated around the forum, add the no
ticket point, ask for proof of NtD windscreen ticket), but rest
assured you will never pay these people a penny.

I really appreciate this response I've never been so confused in
all my life about a ticket. I went on the website to appeal and
put my reg and number in and it says it's been past 28 days. i
then sent an email to the info@ email and received an automated
response saying anything received about a PCN will be ignored
leaving absolutely no way for me to contact for an appeal. And I
totally aggre how can I get a no ticket displayed on an ANPR
carpark. I've requested on the email for pictures but after
reading the automated response I assume I'll get nothing back.
Also the fact that this is the first I've heard of the fine is
crazy to me also because how am I meant to appeal it if it's
gone past 28 days but this is the first I've heard of it. I also
fully believe that I'd know if I had a ticket on my car that
day. Once again thank you for your response

Did you say anything in any emails that would indicate who the
driver of the vehicle was?
If not, I think you can probably safely ignore this (though you
could appeal by post in the alternative) since their
embarrassing NtK suggests they would consider "exceptional
circumstances".
I imagine one of incredibly well informed regulars around here
(probably b789) will be along shortly with a take on this.

Yeah I never said anything about it being my vehicle in the
email so I should be okay on that part.

It's not whether it's your vehicle that is important (they know
that because they got your details as the keeper from the DVLA)
- it's whether you said you were driving at the time i.e. "I
parked and paid at the machine like I usually do" or anything to
that effect.

Ah right no this is what I sent.
Hello,
Today in the post I received a notice to keeper letter. It
states i received the fine due to "no ticket displayed" however
at this carpark you don't need to display a ticket. Furthermore
it says I cannot appeal as I have gone past the notice period,
it says details on how to pay were stuck to my windscreen
however I can assure there was never a ticket on that day. This
seriously needs looking into. I know parking was paid for that
day as it's on a bank statement. This letter is the first I've
heard of this fine. I used this carpark regularly and have never
had an issue before. The machine when you pay even says there's
no need for a ticket as you put your reg in. Sort this out. I
will not be paying for a fine that I had no notice about until
today. PCN number is 53332600 reg is L191 ***(was full reg in
email). I want information about this ASAP. Picture attached
also please. Also reports from your ANPR camera and CCTV of the
payment clearly being made that day.

Remove your name from your pasted email!
I will leave for someone better informed than myself to reply at
this stage if there is anything to be added. Just a pedantic
point for any future correspondence or similar issues you may
have in the future - this is not a fine, it is simply a
speculative invoice from an unregulated parking company.
