Dear all
I would really appreciate any advice or support you can offer. I
have recently received two PCN 53j fines for entering a
pedestrian street, but I had unavoidable reasons for doing so.
My 9 year old son has additional needs and attends a school
located in a restricted school street. This school isn't local
to us. The local authority provides transport for my son.
Lately, he has been highly dysregulated and has even faced
suspensions. When he experiences a meltdown, the school
struggles to manage and calls us at short notice to collect him
immediately.
Due to these challenges, the school requested that we accompany
him on a trip, which meant we had to drive into the restricted
street to park near the school. He has a blue badge, and given
his needs, parking further away was not a realistic option.
Two weeks later, he had parents evening at the school, and once
again, we had no choice but to enter the restricted street to
park as close as possible.
I appealed both PCNs, explaining the circumstances, but my
appeal was rejected. I find this incredibly unfair. Parents with
children with additional needs do not choose these challenges,
and while we do our best to follow the rules, sometimes we
simply have no other option. Dragging an already dysregulated
child to another street is not feasible.
If there is anything I can do to challenge this further, I would
be truly grateful for your guidance.

Barking & Dagenham PCN 53j-Pedestrian Zone, Alibon

all sides of the 1st PCN (only redact yr name & address) and the
1st page of the second PCNs,

I have become aware of your PM (which I have taken the liberty
of copying below) but I suspect too late to give advice for
today. All I can suggest is that
1) You ask the school to hold on to the pupil until the School
Zone restriction ends.(What time is this - you haven't said so
far.)
OR
2) ask the school to drive him to meet you at the edge of the
zone.
In any case, you need to have an urgent meeting with the head at
the school to discuss a way forward..
and possibly your owb local ward councillor(s).
Have you had rejections of all your reps for each PCN so far?

I received the following plea as a PM today, and confess to
being somewhat out of my depth in responding to a no doubt
unforeseen consequence of introducing a school zone. Is this
emergency action by the OP covered by any sort of exemption or
is it just mitigation?
Can anyone give further advice, please.

If your son can walk you need to park outside the school street.
These streets aren't usually very long. If there are no pay bays
you can challenge tickets on assisted boarding/alighting.

OP, from what I can make out from Google Street maps, the school
concerned is accessed from Wantz Road. It also appears to be an
Academy.
Whereas, in Alibon Road (between Hunters Hall Road and Wantz)
there is access to a B&D school - Hunters Hall primary.
Wantz (and therefore your child's school) can be accessed other
than along Alibon Road.
Before you go too far with accumulating additional PCNs, we need
to be clear that in order to access your child's school you must
enter the Schools Street zone. Not just that it's more
convenient, but that you must in order to access the school.
Hunters Hall Primary School
SS11
Alibon Rd - between Hunters Hall Road and Wantz Road
Your child's school is not listed as being within B&D's School
Streets scheme.

This is the school concerned in the OP's reps for one of the
PCNs.
A blue badge is an exemption but it has to be applied for so I'd
say their rejection is wrong in not saying that and in
considering discretion.

Exemption Four – Blue Badge Holders
Blue Badge holders that require access to a property inside a
School Street (including those dropping
off or collecting from the school) during the hours of operation
can apply for an exemption.
Further Notes on Exemption Four
• Schools may be required to confirm the status of parents or
students who are included in an
exemption application
• If you fail to provide the correct proof/supporting evidence
with your application, it will be rejected
• All other applications will be considered on a case-by-case
basis

Thanks. It is rather buried considering how many schools there
are both in Alibon and the vicinity.
But IMO it's essential to get these details within posts. So OP,
to be clear your child attends Hunters Hall Primary School?
From their Parent and Carers' booklet:
We are part of a safer school streets parking area so please
be aware that turning into Rockwell Road and Alibon Road
between 8:00am and 9:15am and again between 2:45pm
and 4:00pm is not permitted. Fines are issued by the local
authority.
IMO, as regards the PCNs we can see I think you need to shorten
your narrative so that only the essentials are presented. For
example, if you have been requested to attend a Parents' evening
by the school then you need to present something from them
regarding why you would need to enter the zone at what was only
7 minutes before the restrictions ended. Similarly for the
morning. I think any appeal would be more focused as a result.
