I received the response from the county court today after I
requested to represent my wife
"Good afternoon
If you want your Husband to be your representative, please
complete form N434, that way all correspondence will be sent to
him.

Before I submit to represent on behalf of my wife, is there
anything I should know before submitting an Form N434 to say we
are not being legally represented? I understand a copy of this
will be sent to the claimaint's solicitors. Not sure if this
will put us at a disadvantage if they know we will be
representing ourselves?
Also, I still haven't heard anything from the court.

No.
The point of this forum, and all of its cases, are about
self-defence.
Caveat: I have no experience of the use of the N434 form. It’s
not unknown for courts to give bad advice.

I received an email from BW Legal in response to form N434
asking to confirm if I have legal representation so they can
update their file accordingly, which I haven't responded to.
A letter was also received in the post today 29/05/2026
essentially willing to resolve the matter outside of court as
part of "goodwill" for £100. Offer expires 18th June which I
will not accept.

Morning,
Court date received in the post scheduled for 21st August 2026
at 10am. Slightly annoying as it's at Civil Courts RCJ, WC2
whereas I opted for my local county court. As mentioned before,
my wife has mentioned she does not want to go to court and wants
to just pay it but I want to fight it.
In terms of the trial fee of £27.00 I take it that is for BW
Legal to pay and not for me?

The claimant pays the fee, not the defendant, so BW Legal need
to pay or discontinue before 4pm on 30 July. If the fee is paid,
you and BW Legal need to send the court and each other a Witness
Statement by 7 August, two weeks in advance of the court
hearing.

Thanks for the quick reply.
I take it my next steps now are to just wait and see whether
they pay it or not. If they have and I receive their witness
statement, upload it here for advice before proceeding and
sending them mine in return?

Unless you want to scramble at the last minute, you should draft
your witness statement now, at least in outline form so you know
what you’re going to write. It needs to be a chronological
statement of the facts in the witness’s own words, which is
presumably your wife’s statement and not yours. As @DWMB2 posts
frequently, it’s better to assume the case is going ahead and be
prepared for it, in the worst case you will have spent a little
time and effort which comes to nothing but you’ll learn
something from it. You may additionally be able to rebut
anything in their WS at the last moment, but their WS won’t
substantially alter your wife’s.

I've just ultimately followed the advice from here, copy &
pasting my defence so is it best to just use that as my witness
statement or break it down into more simple terms, so it comes
from my wife as to why she should not pay and quoting XYZ from
my previous defence.
Also, if it comes to it, Is it still possible to just pay the
reduced offer of £100 which they sent last month? As both my
wife & I would have to take the day off work this and no
guarantee of "winning", it's probably to safer option to just
suck it up. However, if it is more likely to win that not then
I'm willing to take the chance.

You ned to research what a Witness Statement is, it’s not a copy
or rehash of a template/boilerplate defence which only moans
about the process. Especially since it’s the basis on which you
could be questioned in court, so you need to understand it.
