Tyne Tunnels, unpaid toll charge, Northbound Tunnel

The girlfriend has gone through the northbound Tyne Tunnel. It
is not a regular route that she takes and she just forgot to pay
and then got this 'Unpaid toll charge notice' asking her to pay
both the Class 2 (Tyne Pass) Toll fee at £2.40 and also the
'Unpaid Toll Charge' of £60.00.
Is there anything she can do about this charge?

Unlike Penalty Charge Notices served other river crossing
authorities, the Tyne Tunnel toll enforcement is under its own
bylaws, not the national regulations for road user charges, and
the criminal law applies.
If they want to enforce a penalty, the recipient of the UTCN
having not paid or appealed, they eventually have to take the
matter to the criminal courts, in the first instance this would
be the magistrates courts.

We see very few Tyne Tunnel cases on here, so there are not many
contributors on here with the necessary experience to give
considered advice, however, wait a bit to see if someone comes
on with more advice.
The real puzzle is why the Tyne Tunnel persists with this legal
framework when there is a ready made set of regulations under
English civil law, they could use that is fair to both parties.
Personally, my opinon is that your best move is to submit
representations and if refused, pay-up. Is there any mitigation
that caused your girlfriend to forget ? In the reps, also say
you are willing to pay the toll.
The above advice may not be totally correct so, again, see what
the others say, but don't miss any deadlines.

So I have asked her what caused her to forget and she said just
that she felt like death for a few days and just simply forgot.
So according to the letter she has until 24th January to pay the
reduced charge of £30 for the fine and also £2.40 for the toll
fee that should have been paid, so £32.40 in total and then it
goes up to £62.40.
So should she try a representation to the effect of apologising
for her oversight, she felt poorly and that she is very willing
to pay the £2.40 that should have been paid?
Or best just to pay the reduced charge in case they don't re
offer it after the 24th?

I suggest submitting reps now (as in today 21st Jan), and if
she's nervous, paying the discounted amount on the 23rd. If you
or she is going to use the tunnel a lot, why not set up an
auto-pay account.
