Yellow lines, green circle and fog

Hi
I've received a NIP asking for driver information. I've been
able to logon and see the photographs.
From a bit of searching, I think the yellow lines are to measure
the speed - should there be a second photo passing the other
yellow line because there isn't one?
And again from searching, I understand the green circle is to
identify the VRN of the car being measured, but in this case the
circle is not on the VRN - does this give a way out?
Also, one of the photos is totally misted up so that nothing can
be seen. Does it give a way out?
NIP says the vehicle was recorded at a speed of 79 mph so from
what I've read on the 'read this first' post it sounds like it
has only just hit the threshold for prosecution. Not the best
Boxing Day present I've ever had :( <BR>

79mph in fog?
that had the possibility of attracting a DWDC I would have
thought.
the second pic usually shows the previous gantry displaying the
restricted speed but in this case there was no restriction.

The second photo is taken by a camera further back, to show what
was displayed on the gantry at the time the snap of the speeding
vehicle was taken. It's included to stop the naysayers claiming
a higher speed was being shown at the time. It's not a
requirement however for prosecution, the log for the gantry in
question will state when the speed limit was set. Which in this
case is immarerial since the speed is NSL and has been for over
a day.
The two lines is a "prediction" where the vehicle in question
should be located if the speed detected is correct.
So either accept you were speeding and take the offer of a
course (if made) or the fixed penalty. You will have to name
yourself as the driver before any of that will happen.

Actually I rather like the idea of pleading not guilty and then
in Sec. 8 of the PET form entering 'unable to see speed limit
sign due to dense fog'.
That is the sort of thing that gets printed and put on the wall
in HMCTS offices.

To be pedantic, if the driver is traveling at 79mph, the speedo
will be a displaying 83mph or so!

lol to be pedantic it would probably depend on how good the
speedo was
but yes it would most certainly read above 80.
..... in thick fog :o

Just to clarify, that this was definitely not thick fog. The
photos from the two cameras are definitely different with the
one supposed to show the speed limit signs looking like it's
dense fog, but the speed camera looking like a light mist.
There's no way either me or my wife would be driving that fast
if the fog was as it was in the speed limit signs camera. Even
the speed camera makes it look worse than it was. It was Boxing
Day and not that foggy - at least 500m of visibility. I think
the combination of a night photo and light fog makes the picture
look worse than it was.

to go back to your original post,
you won't get off this with any of your arguments/theories
you will be in serious trouble if you don't respond to the s172
by naming the driver.
