They won't give up, but I'd probably be tempted to reply - any
correspondence may well be shown in court at some point. If it
were me I'd probably want to draw a distinction between the
ridiculous 'Stamp' case and your defence, as their attempt to
draw comparison is misguided, namely because you haven't used a
stock template. Even if you had, the judge in the Stamp case was
specifically critical of claimants using templates that are
"nonsensical" and that list "elderly statutes and home-made
legal labels". The only statutes/cases you list are from 2012
and 2015 respectively - this is rather different to Stamp et al
trying to rely on the Magna Carta from 1215.
There's a clear difference between blindly using an
inappropriate template, and writing a defence that directly
addresses the Particulars of Claim - where Particulars of Claim
for different cases are practically identical, it is inevitable
that defences will likewise be similar.
I wouldn't get drawn into any extended back and forth, but
there's probably no harm in getting your objection on record.

I agree with all the above.
What's also worth pointing out is that the defence is 'fine
tuned' to the specifics of the case rather than being a generic
internet defence.
Their letter is simply an attempt to pressure the defendant into
paying through the use of dramatic language.

I was meant to have the mediation appointment this morning. I
got my call from the mediator saying the other party didn’t
answer the phone and that now the case will go to a hearing.
What are the implications of this?

The case will simply progress.
In the event it does go to a hearing, ensure that the judge is
aware of their lack of attendance, and make clear that you
attended fully willing to engage.

Moorside are a complete mess at the moment.
With a bit of luck they will get shut down.
On top of that, NCP are in administration so goodness knows how
Moorside can expect any money out of all this?
Absolute chaos.

Hi
I have this morning received a hearing date - in person - for
16 September at Birmingham County Court. I'm slight surprised
its happened so quickly!
Why I have only just received this despite the order to list the
hearting being made on 28 July and being issued on 15 August I
do not know, but I suppose that doesn't matter.
It says that NCP have until 4pm on 1 September to pay the fee,
or the case will be struck out.
The letter is rather confusing, but appears to say that both
parties have to provide copies of all documents on which they
intend to rely no later than 14 days before the hearing which by
my calculation is also 1 September (or possibly 2 as I'm not
sure exactly of the timings and what counts as the cut off) so
it doesn't leave me much time to actually pull anything
together.
I'm not clear what exactly I need to provide at this point and
when - the documentation from the court is extremely unhelful in
this regard.
Am I right in thinking this is where i have to submit my witness
statement and photos of the broken machine, the email that the
other side did not attend mediation etc?
I'm still hopeful that they just wont pay the fee or submit any
evidence but given the tight timescales I cant really rely on
that.
Any advice would as always be most appreciated.

Please post the documents you have received rather than
summarising them, so that we can give you the best possible
advice.
You should consider what your witness statement might be, so
that you can submit one in a hurry, but from the dates you have
posted it’s quite possible that the claimant will discontinue
rather than submit a witness statement and pay the court fee.
Remember that the requirement on the submission of witness
statement applies equally to them as it does to you.
