       Multiple PCN's in a car park 'controlled' by Excel Parking

       I know of a person that has been through mediation with one of
       the adjudication services offered by Excel Parking Services and
       have also read the post dated 23rd October 2024 from A.N.OTHER
       regarding the same site.
       The person I have spoken with, is going to check, but believes
       they have received a letter of claim from EPS for alleged
       contraventions that occurred in respect of this nonsense 5
       minute rule they try on.
       They have been through a mediation but could not recall whether
       or not it was IAS or one of the other biased services available
       for these operators.  They will check later and I have asked
       them to post up in the hope that you can help them.
       I've told them not to hold their breath now that it appears to
       have gone this far but I am hoping that until Excel place it
       before a court that hope is not completely lost.
       They have been approached by some TV programmes about their
       experience so I have advised them to sit tight for now until
       they get advice from this excellent resource. I fear that a TV
       presenter asking a seemingly innocent question could potentially
       cause some issue further down the line.
       They have retained all documentation and proof of payments for
       these PCN's which were early 2023!
       They have also already paid one PCN to 'get them off their
       back'.  Maybe if it goes to court the judge may award a refund
       too...  :D
       Just trying to get some preliminary advice as to what they
       should post up with some many PCN's issued.
       I've advised them to read the necessary guidelines prior to
       posting too.

       We'll need to know detail of the case - as a starting point,
       exactly what stage of the process they are up to. Ideally, they
       should provide a timeline, detailing exactly what they received
       when, with exactly dates, and any correspondence they sent,
       again with dates. If their argument is that they paid, but just
       paid outside of the 5 minutes Excel allow, they should also
       confirm to us that they have proof of payment for each parking
       session they received a PCN for, and that their payment covered
       the duration of the parking period covered by the PCN.

       They'll never get a refund for the first PCN they paid. Paying
       it is an admission of liability and weakens their otherwise good
       case for defending.
       Any "mediation" they may have been through prior to receiving an
       actual N1SDT Claim Form from the CNBC is unlikely to be anything
       official. It will only have been an appeal to the kangaroo court
       that is the IAS which is anything but "independent".
       The only way that this will be concluded is through the only
       truly independent dispute resolution service, the small claims
       track of the county court. WE can advise and provide templates
       or even bespoke defences against scammers such as Excel or their
       sister company VCS.
       The 5 minute rule that was mentioned and has recently been in
       the press, is an unenforceable "penalty" in contract law. There
       is ample defence in that alone but if you include the Consumer
       Rights Act 2015, it becomes even stronger.

       For clarity, this is the case I referred to above - the news
       article suggests a claim form has been received. We need to see
       exactly what stage we're up to here.

       To save me searching, is Mr Yamba the poacher turned gamekeeper
       who knew that most of the PPC PoCs were bollox because he wrote
       them?
