53j - Redbridge - failing to comply with a restriction on
vehicles entering a pedestrian zone

Good evening,
My Dad received the attached PCN for passing trhough a school
street, they did not realise it was term time as there was not
children so thought the term had not started, is there any scope
for an appeal. Any advice much appreciated. Thanks

Unfortunately Google Street View is not up-to-date at the
location, but a look at the other end of Colvin Gardens where
one turns in from Tomswood Hill shows two "Flying Motorbike"
signs with restriction times, but nothing about term time.

PCN time of contravention is 15.27, so well inside the afternoon
restriction. If the council don't enforce outside term times it
is not conveyed on any signs, although to be fair the GSV view I
posted is July 2021. Can you or your father confirm the sign
shown on the 2021 GSV view is the same as is there now ?
The video shows you charging past the signs on Colvin Gardens,
so this will be difficult to overturn, but post some
representations based on the term time issue. Signs seem clear
enough in the video, and your father hasn't said he didn't see
them so one can assume they are prominent enough.

I went to the road and it looks like they have added in the Term
time sign, please see below and kindly advise if I have any

I was thinking of sending them this:
I am writing to formally appeal the Penalty Charge Notice No.
AF99076474 53J issued for an alleged violation of “failing to
comply with a restriction on vehicles entering a pedestrian
zone” on 2nd September 2024 at 15:27.
Upon review, I respectfully contest this PCN on the grounds that
the restriction was issued under circumstances where no students
or school-related pedestrian traffic would have been affected.
To my understanding, the school in question was closed on this
date, reportedly a staff training day. No children were present
as it was in effect a non-term day, meaning there was no
pedestrian activity warranting the enforcement of the zone
restrictions.
Schools in the Redbridge area operate on different term
calendars, and it is impractical to expect residents to track
every school’s unique dates to comply with restrictions intended
for student safety. This lack of alignment between term dates
and traffic enforcement creates confusion and ambiguity for
residents who wish to adhere to regulations but have limited
access to accurate, comprehensive information regarding
individual school schedules.
Given that the pedestrian zone restrictions serve primarily to
protect students during active school days, enforcing the
restriction when no students are present contradicts the spirit
of the regulation. Therefore, I respectfully request the
cancellation of this PCN, as there was no risk to pedestrian
safety on this particular day.
