       52JM - Failing to comply with a prohibition on certain types of
       vehicles (Church Rd Northolt)

       Hello everyone,
       Three weeks ago I drove down a street in Northolt that turned
       out to be a restricted access street. I had seen the speed limit
       sign but not the other sign below it that they say was there. On
       google maps, I now see the sign giving the rule but I had not
       seen it at the time. Probably because when turning in off the
       busy road, I didn't have much time and/or because the first was
       so prominent I assumed any other signs (if they were there at
       the time) gave related info to speed. I just can't remember.
       Question. I my wife and I were in 2 seperate vehicles (she was
       immediately behind me) drove down it but only my wife received a
       PCN. I was driving a regular sized box van. Looking up the
       signage on google maps, sign has an image of a motorbike and a
       motorcar within a red circle. Does this mean that VAN's are
       allowed or that the camera didn't catch it or that the PCN
       somehow didn't reach me?
       I want to find out if a PC has been issued so that I can pay it
       before it doubles to £130. I tried calling them on Friday gone
       but every option diverts to an automated message. Their website
       allows you to request a lost ticket but it takes 3 days which
       would take us beyond the 14 days.
       Would appreciate some help on what to do?

       Clearly you don't know what the "FLying Motorbike" sign means.
       Essentially, for the ordinary motorist or van driver, it means
       "No Entry". but actually means "No Entry for motor vehicles".
       It can also be qualified by signs underneath, like "except
       permit holders" or such like and can be time limited. Its no
       good submitting reps that say you didn't understand the sign.
       However arguments around sign positioning are valid but you need
       to prepare a strong case.
       As Hippocrates says, keep quiet.  If you get a PCN come on here
       again.

       You could have sent a one line representation saying
       contravention didn't occur and that would have preserved the
       discount, and they might have messed up the response. As it
       happens I think we could have found something substantive but
       obviously I'm not going to look into it now as it would be
       academic.

       Hi All,
       Okay so I paid my wifes PCN and decided to wait if a PCN would
       be sent to us for my vehicle since there was no other way I
       could check for one.
       Early september I received a Charge Certificate where the PCN (I
       never received had gone up by 50%), I emailed the only address I
       could find (ParkingRep@ealing.gov.uk) the below message
       (included is their automated reply). I have not had anything
       from them since and they do not take phone calls for me to ask
       either. A few moments ago I logged in to their portal to see if
       the PCN was still live and for how much, and it is exactly as it
       was (£195). I also noticed some tabs along the top of their
       portal which I had not noticed or seen previously. These tabs
       include 'Make a Challenge/Representation, which when clicked
       brings up fields for all of their requirements to make a
       challenge. I'm a bit flummoxed as to what to do. Should I fill:
       1. Fill in their form to contest the ticket
       2. Wait for a letter re my initial email representation (worried
       about this in case their so called letters dont arrive and
       charges escalate)
       3. Email them again on the only address I have for then asking
       for an update?

       I have received a charge certificate for the above alleged
       contravention. In the letter it states that you served on me a
       PCN and that this CC is served because I did not pay the said
       PCN.
       I did not receive any such PCN and if one is not served, I will
       have no choice but co contest it through the proper channels.

       Informal challenges = 30 working days
       Formal* representations = 30 working days
       *We will consider any written challenge submitted against the
       issue of a Penalty Charge Notice (PCN) up until the issue of a
       Charge Ccertificate. However, correspondence is only considered
       to be ‘formal’ once a Notice to Owner, Enforcement Notice or
       postal Penalty Charge Notice has been served to the registered
       keeper of the vehicle.
       We aim to respond to all representations within the time periods
       stated above.  Please avoid contacting us for an update about
       your case during this time, as this may cause further delay.
       Please also allow extra time for your correspondence to reach us
       if you have sent it in by post.
       
       If your correspondence is received within the discounted period
       stated on the PCN,  we will place the case on hold and honour
       the discounted amount regardless of how long it takes for a
       response to be issued.
       Correspondence received after the issue of a Charge Certificate
       or Order for Recovery will be placed on to the case but there is
       currently no specific time period within which a response will
       be sent to you.  Equally, if correspondence is received after a
       case has been paid in full, it will be placed on to the record
       but there is no statutory response period.
       If you wish to contest the issue of a penalty at either the
       informal or formal stages then please do not make payment.
       Doing so will close the case and there is no form of appeal once
       the case is paid and closed.

       Please ensure that you provide your PCN reference number,
       vehicle registration number, name and current address details
       when corresponding with us.  Without these details we may not be
       able to locate your records and the case may progress.
       Formal representations
       
       Responses to formal representations are sent to the DVLA named

       received the case will be placed on hold and investigated.  If
       the PCN is not cancelled then a Notice of Rejection will be

       With all the reports of late or even lost mail we see on this
       forum, may I suggest you phone TEC asap to find out of the PCN
       has been registered, and if so, when.
       According to the TEC notes on the PE3, 36 days are allowed for
       submission of a PE3 against an Order for Recovery. In-time
       submissions are accepted automatically. You need to avoid
       running out of time, because getting an out-of-time submission
       can be a real PITA and often fails.
