       Euro car parks County court -no permit - The willows Centre main

       A letter was received to my address which was a county court
       claim form made against my name from Euro Car Parks. As you can
       see in the letter, this alleged PCN is from October 2020. I am
       no longer the registered keeper of the Vehicle not since 2021,
       and i cannot even remember where this alleged contravention took
       place. I have googled The willows centre main and got a few
       places. One is a shopping centre of some sort.
       I have read the very helpful guidance of @b789 for similar posts
       and aim to follow that. I saw that the advice is not to complete
       the claim on the MCOL site, i could not log in anyway as the
       information they provided as login details did not work.
       So from the advice given i should use the paper forms attached
       to acknowledge receipt, and my intention is to defend all of the
       claim. with regards to the template letter to send, please
       advise what i can use.
       I have never had something like this, asking for a so called
       debt 4 years later.

       Welcome. Don’t use the paper forms if at all possible. You can
       do the AoS by downloading the N9 response park form here:

       Fill in the details online and type your name for the signature.
       There is no need to print or scan anything. When you’ve
       completed it, send the PDF as an attachment to:
       claimresponses.cnbc@justice.gov.uk and CC yourself. Make sure
       that you include the claim number in the subject field and
       simply say in the body of the email to see attached N9
       Acknowledgement of Service (AoS) for claim [number] in the case
       of [PPC (claimant] v [your name] Claim [claim number].
       Make sure you receive an auto-response email back from the CNBC
       which should be almost immediately after you send it. If you
       don’t receive the auto-response email, keep trying until you do.
       If necessary, try using a different email agent.
       With an issue date of 28th August, you must submit the AoS no
       later than Monday 16th September. There is nothing to be gained
       by delaying it. Once the AoS is filed, you then have until 4pm
       on Monday 30th September to file your defence.
       Get the AoS done for now. Once you have confirmed that it has
       been done, we will assist with a defence.
       As this claim has been filed by DCB Legal, there is a 99%
       likelyhood that
       N they will discontinue before any hearing as long as a defence
       has been filed.

       Thanks alot for the steps so far. I have sent the AOS as advised
       and received an auto response.

       Did you ever receive anything about this alleged parking event
       back when ECP say it happened? Did you ever receive windscreen
       Notice to Hirer (NtH) or a postal Notice to Keeper (NtK)? Did
       you receive a Letter of Claim (LoC) from DCB Legal?
       Whilst you may not own the car anymore, that is not going to
       absolve the driver of any liability for the alleged debt.,
       assuming they can prove that the keeper was also the driver at
       the time,  However, the claim is against the Keeper but we don’t
       know if they are able to hold the keeper liable under the
       provisions of PoFA.
       So, in order to be able to provide a defence, can you please
       provide a timeline of the associated paperwork that was received
       about this PCN. Exact dates, if possible, for the initial PCN.
       We don’t need to know about any reminders or debt Cole for
       letters. Just the initial PCN (NtD and/or NtK) and LoC. Was the
       correct address on the vehicles V5C at the time of the alleged
       parking event?

       I honestly do not have any documentation from them dating back
       that far.
       I cannot find anything relating to this PCN. i was even
       wondering if the coincindence in me receiving this PCN of 4
       years ago is as a result me recently beating them at one other
       case where i countersued them and they withdrew their case. Not
       sure if they can be that petty or just pure coincidence.
       I have moved home since 2020 and could have misplaced any
       documentation initially sent, if one was sent.

       Euro Car Parks do have a habit of occasionally trawling their
       back catalogue and issuing a bunch of claims. They did it during
       COVID too, if I remember rightly.

       Do you know or remember that the V5C for the vehicle had the
       correct address at the time of the event? It is a fairly common
       problem that people change address, update their drivers licence
       and either assume that their V5C will be updated automatically
       by the DVLA or simply never get around to changing it.
       This is usually the reason that people get claims or worse,
       default CCJs out of the blue.
       Did you receive a Letter of Claim (LoC), as required by the PAP,
       at least 30 days before the claim was issued?
