Hello
The date of the incident was 8 July 2024.
I found an enforcement notice dated 12 August at my home after
being away for 2 weeks, referring to a PCN “batched” on 11 July.
I never received the PCN. I live in a flat with a separate
front door from the other flats in the building, so post is
sometimes delivered (by Royal Mail as well as by others) to the
wrong door.
I have off street parking in front of the house, reached over a
dropped pavement.
That stretch of Clapham Road is an all times bus lane, which
also has a marked cycle path.
I believe that I am allowed to cross the bus lane to reach my
property, and my own practice is to cross opposite the entrance,
drive a bit further parallel to the pavement, and then reverse
in. Going in forward would be difficult for the parking area,
but more importantly it would be dangerous to reverse out across
the pavement with no view of it.
I have been living there for 6 years, and have never had any
PCNs. A camera has recently (not sure exactly when) been
installed to cover this stretch of road, but I have not received
any PCNs when I have been driving.
On this occasion I was not driving, and the driver entered the
bus lane about 2 houses before our entrance, which is between
the white topped pillars – photo 1. The reason for entering the
bus lane early is that it is safer because of the frequent
cyclists in the bus lane – although there were none on this
occasion. Photo 3 shows the car stopped and about to reverse
into the entrance.
I need help with my representations in two respects. The
non-receipt of the PCN, which has increased the penalty from £80
to £160, and a challenge to the penalty because of the need to
enter the bus lane to get to my property. I have until 9 Sept
to make representations.

Clearly a difficult situation for parking at your address !
It looks as if the driver of your car entered the bus lane at
its start, although until you obtain and post the video this is
conjecture on my part, but the photos show the car in the bus
lane very close to its starting point. This will be why the PCN
was served.
I think the way you handle the situation for backing-in without
getting a PCN, must mean they look at your manoeuvre and decide
not to serve a PCN. Your driver was obviously not aware of the
"procedure", i.e to not drive any distance in the bus lane.
You need to get the video off TfL, (it's a DVD) and post it
here. This should freeze the process for about 2 weeks, but
check with TfL when requesting it.
If you have to submit some reps, (video hasn't turned up after 2
weeks), you need to emphasise two things: -
1. The driver was driving so as to be able to safely back the
vehicle into the property. Emphasise it is essential to back in
because vehicles cannot be turned round, and backing-out is
extremely dangerous as there is no visibility due to the wall.
2. Due to problems with postal delivery, the PCN was not
received by yourself before they served an EN therefore you have
lost the discount opportunity and request it is re-offered.

You have to ring them up. Make sure you mention you're at EN
stage because the PCN never arrived.

Ask them for the PCN too as the last one I saw had wording
issues.

Thanks for the advice.
I rang TFL customer service on 0343 2221234 and was told to ring
0844 5448458, which says it costs £5 per minute.
I then searched online for a PCN query number and found 0343
2223333, which worked.
They will send me the video, and a copy of the PCN letter. I was
first told to look online for this, but only found the bare
data. I had to insist that I wanted the full letter, and that
is being sent.
I was also told that the PCN is on hold, and to ring them if the
stuff had not arrived by 10 September. I asked for the discount
back and was told to raise that if/when I am going to pay.
I will upload as soon as I get anything.

Make sure that 10th September is in your diary because the
'Hold' will come off on that date even if you haven't received
the video. We've seen quite a few people just wait around for
it, and over-run the Hold period and also the deadline for
payment or appealing, and thus lose their right to submit reps.
