Speeding M6 NIP

Dear All
Hope all is well.
My younger brother received this recently. I can see another
post with the exact location and speed. My brother advises that
he was not sure if he was overtaking and got caught at 79mph.
It was a hired car as his was broken. Any help guidance would be
much appreciated.

Your brother needs to reply naming himself as driver, or he will
be guilty of a much more serious offence.
If it was 79 in a 70 limit, he will be offered an awareness
course (if he is eligible) or a fixed penalty - £100 and three
points. Unless he has a good defence, he would be well advised
to accept one of them.

done aside from returning the form to the police naming the
driver and awaiting the outcome.
Does your brother accept that he was doing 79 mph, or is he
saying the speed reading from the camera is wrong?

Thanks CP
How would one challenge the speed camera and has anyone from
your wisdom ever succeeded. Do they not show video footage of
the actual speed?

Broadly speaking, we offer advice on the law applied to the
facts provided. We will not suggest "facts" that if adopted and
somehow proven might constitute a defence.
There is a myth that there is an allowance for overtaking on a
single carriageway to reduce the time exposed to danger (the
amount of time on the "wrong" side of the road). If you are on
the wrong side of the road when overtaking on a conventional
motorway, speeding is the least of your worries.

None. The speed limit applies in all circumstances.

still images? Sorry never dealt with these things so apologise
beforehand if this is a silly question.
