       NIP - 25mph in a 20 - Location A3 Kennington Park Road nr

       Hi All,
       New to the forum.
       I have been sent a NIP for driving my van at 25 in a 20 MPH, I
       have some questions regards a potential challenge, apologies if
       a bit basic!
       Also I have been offered a speed awareness course + the cost.
       1) The "Speeding “10% plus 2 miles", means the guideline upper
       limit is 24 mph...is it worth challenging on the basis it may
       have been rounded up to 25? (more on this coming)
       2) As you can see from the photos, another delivery vehile was
       in the bus lane and obstructing the view for the camera in
       question.
       a) Would this have effected the accuracy of the camera measure?
       as you can see its obstructing the lines on the road from the
       camera photos, which I assume it uses?
       b) A car behind was speeding at points and tail gatting the van
       (causing me to speed up at points), is it worth writing in about
       this once I have the next letter?
       Yes I have been offered a speed awareness course + cost...but my
       point is do any of these circumstances above (or anything ive
       missed) likely to gain a successful challenge?
       p.s. I have filled out the form and returned it stating who the
       driver was.

       1. 10% plus 2 is the starting point for action, not a "leeway",
       so even if you'd been recorded at 24 it would not help. Plus
       AFAIK the recorded speeds are rounded down to the nearest
       integer, not up.
       2.  No photos attached. You need to upload them to a 3rd party
       site (e.g. imgur.com) and then post a link
       2(a) The camera uses laser or radar to measure speed: the lines
       are a secondary check
       2(b) If your being tailgated, the correct action is to slow
       down, not speed up.

       Thanks pictures now up.
       When you say 'correct action' I do understand, however when you
       driving a brand new van, you tend to not want to be rear ended
       and that is human nature - thanks

       From the pictures, this tail gating car appears to be at least
       two vehicle lengths back or more. I think if you were to
       challenge it on this basis, I would want to see evidence
       slightly better than a van with empty road behind it. However as
       has been mentioned, correct advice is to slow down not speed up.
       Speeds are rounded down, not up (can you imagine the outcry if
       prosecution was enabled by rounding up speed?) However, speeding
       is exceeding the limit which at 24 you are doing. It has
       happened now, no mileage there other than to admit to speeding.
       Lines are secondary check only, speed is measured by the device.
       However it does look as though you could perform a secondary
       check from those pictures.
       Personally, I think you are wasting your time. You could check
       the traffic order is correct and that the 20mph limit is
       adequately conveyed. However since London went 20mph some time
       ago, I would expect everything to be water tight now. But
       nothing you have mentioned so far is a defence to the charge.
