Actually, not quite. They still refer to service date in the
first sentence under Enforcement Notice.

Not really, as the ICO was not provided with any substantive
arguments as to why the exemption applied. Another council could
try and come up with a better argument. It only really becomes a
precedent if it gets to the First-tier Tribunal, but I have a
number of TFL cases headed that way at the moment.
