Re: APCOA - PCN - Luton Airport - Dropping off outside
designated area - Feb 2024

Good morning all,
I hope you had a nice week-end.
Can I please kindly check as which option from POPLA's grounds
of appeal are applicable here? Is it "I was not improperly
parked" or "Other"?
Is it advisable to add the appeal grounds as text on POPLA's
platform or as pdf or word doc attachment?
Thanks in advance for your views.
Kind Regards,
Almep13

Always "Other". Do not be fooled into ticking something that is
making you admit to being the driver.
Just create your appeal as a PDF document and upload it.
You can show us the content before you send it if you'd like a
critique.
The POPLA deadline is actually 32 days after the date it is
issued, even if they say 28 days.

Thank you [member=26]b789[/member] for the prompt response, I
appreciate it.
I was going to go with your version, but just adding the below
paragraph at the end of point 3 in your appeal grounds.
"...Attention is also drawn to the fact that POPLA's Complaints
Team has twice issued apologies for assessors wrongly applying
keeper liability for parking on airport land and confirming
that, as airport land is not 'relevant land' as defined in PoFA,
there can be no keeper liability for parking on airport land.
The most recent apology relates to POPLA case 4822223007 and was
issued on 7 December 2023."
Thank you and regards,

Dear Forum members,
I hope you are well.
POPLA has just emailed to say that the appeal has been
withdrawn, which I believe it means that APCOA has withdrawn its
PCN.
The notification doesn't give the justification for the
withdrawal by APCOA.
Thank you all for your advice and assistance in this matter, I
appreciate it.
Kind regards,
Almep13
