DCBL actioned CCJ- Need to pay before 15/10/2026-
   DIR By: Firstpcntoday

       ---------------------------------------------------------
       Afternoon everyone,
Hoping for some advice regarding this CCJ. If it is not paid by
15th October, then it will be filed on credit report.
Trying to state facts but this is from 2021, therefore timeline
       might not be accurate.
Driver used car at said facility- 2021
Driver actually paid for parking at facility. Personal
circumstance arose to where the driver had to go to hospital,
car had to be collected by someone else- 2021
Ticket arrived and an appeal was made by the driver rather than
       registered keeper- 2021
Not sure of outcome of appeal
Last letter to arrive was in 2023 from DCBL.
Driver spoke to DCBL stating there was no outcome of appeal and
no chance given to pay full amount. DCBL refused to comment on
       this.
Received letter from DCBL 28th September.
Driver is tempted to pay but awaits opinions regarding this.
Link provided below of the letter and claim form. Outside of the
       14 day period to respond.
       Any possible route?
       Kind regards

DCBL and DCB Legal are different companies. The former is a debt
collector and can be ignored. The latter are solicitors. I
assume you are referring to them.
If you have a County Court Judgment, you can either pay it or
ask for it to be set aside. To set aside, unless there has been
an error in the process, you need to pay >£300 and convince the
court that you have a chance of successfully defending on the
       second attempt.
If DCB Legal used an incorrect address, then you may be able to
get this set aside. If you received the N1SDT claim form but did
not respond by 9 September as required then DCB Legal are
entitled to obtain a default judgment against you.
Did you receive the claim form and what did you do?
On the face of it your best approach is to pay this, unless you
can demonstrate mitigating circumstances and get the judgment
set aside at no cost to you.

       Hello,
Thank you for your quick reply.
Yes you are correct in that this is DCB Legal LTD.
I have not received a N1SDT form. The only thing that was stated
in the pack, is an N9A-N9B form.
The claim form i still have. This is my first CCJ, so honestly i
have been unsure of what to do. I have also had other personal
circumstances with a family member in hospital, so i have not
       paid attention to this.
What can i do in this scenario? To challenge it regarding the
wrong address, what is my best defence for it?
Would i need to pay the circa £300 for it to be set aside? I am
currently am not working and do not have savings, sadly.
       Kind regards

You posted the N1SDT form above.
This is the claim form. Dated 21 August.
Did you receive it, was it correctly addressed, and did you
       respond to it in time?
If you did receive it, but did not respond because “I have not
paid atention to this” then DCB Legal applied and obtained a
       judgment in default against you.

Apologies, was not aware the claim form was the N1SDT form. I
did not read it anywhere for it to be specified by that.
Yes i received the claim form end of last week.
I have done nothing, as i am not aware of how to navigate this.
I have understood that i can pay for this, but i am asking if it
is worth me trying to fight it.
Since i received it late last week, i am already out of the
       timeframe for the 14 days.
       Kind regards
Edit: i confused myself with the dates of the claim form. I was
not in the country from 22nd August-03 Sept

I do not understand why you only received the claim form "end of
last week" when it was dated 21 August.
However if you were out of the country until 4 September then
you also say that you missed the response deadline of 9
       September anyway.
Is there any reason why you only received this "end of last
       week"?
You may be confusing yourself but you are also confusing me!

I have confused myself and in turn confused you.
The N1SDT form was dated 21st August but probably arrived some
days after that. I was not in the country from 22nd August till
03rd September. I came back to plethora of letters, and put them
to the side that i will get to them. Due to other circumstances,
i clearly did not check this claim letter in time.
I then received the letter from DCB Legal, which i received end
of last week, dated 28th September. After reading this letter, i
went back to the letters i assumed i would get to, and found the
       original claim form.
I am only emphasising about receiving the letter last week,
because if i had received it earlier, by a couple of days at
least, then i would have more time to figure this out.
This is the timeline of it.
I now need guidance on how to navigate from here. Do i pay or
try to contest with the rough details i have given regarding the
       issue, form my initial post

Thank you, that makes sense to me now!
You did not respond in time, for whatever reason, so a judgment
in default was requested and obtained against you.
This is why DCB Legal makes court claims - it just about never
actually goes to court but if the claim is made and not
responded to it can claim a default judgment.
My advice is to pay as requested. It will cost you >£300 even if
the court accepts your request to set aside the judgment, for
which you would have to convince the courts that you have a
reasonable chance of winning if you defend the claim. And you
probably won't get the court fee back anyway.
You only avoid the >£300 fee if the mistake was by the courts or
by the claimant. From what you say, the mistake was yours.
Basically you ignored the claim for whatever reason and failed
to respond within the required deadline.
DCB Legal's letter says that if you pay in time they will notify
the court of the payment which is what you want, and as long as
paid by 15/10 the record of your CCJ will be removed from the
Register of Judgments, Orders and Fines. This is what you want.
If you do not pay by 15/10, even if you pay later, you will have
some kind of record on the register for six years which will
       affect credit etc.

       Thank you for explaining.
I have been tempted to pay but just wanted to see if there were
any viable options. Seems like i am the small percentage of
       claims actually going to court.
Just to clarify, the contravention date was 18/08/2021, that
does make it 6 years. Does that mean they submitted the claim
before that date to keep it valid? The letter i received was
dated 21st August 2026. Just want to know if i am missing
       anything here?
With regards to payment, i am to pay DCB Legal directly and
obtain proof? Is there a chance they could still try to apply a
       CCJ after the deadline date?
       Kind regards

       6 years from 18/08/2021 is 18/08/2027.
You already have a CCJ. It's the record on the Register of
Judgments, Orders and Fines that you need to care about.
Pay DCB Legal in time and keep a record. They say that they will
remove the record. If they don't, you can separately apply to do
       so with proof of payment.
       Or don't pay - I don't care - it's up to you. I'm only giving
       you advice.
Many many claims go to court in the sense that bulk litigators
issue county court claims. It costs them nothing. Anyone who
doesn't respond in time gets a default judgment against them,
again costing the claimant nothing. It's only when cases are
defended that these cases are discontinued, because the claimant
is then required to pay a court fee. Please don't think you're
"unique" or in a "small percentage". Because you're not, we are
able to advise you based on the multitude of similar cases.
