Parkingeye - Holiday Inn Heathrow
DIR By: tapenade007

---------------------------------------------------------
Hello,
About a week ago, the driver dropped a paying guest of the
Holiday Inn Heathrow at the hotel and parked at the parking.
There was no barrier and neither the driver nor the guest did
notice any information regarding the parking. Then the driver
accompanied the guest who checked-in (there was queue there so
it took about 15 minutes) and then helped the guest to bring its
luggage to the room. Then the driver left the premises and drove
away and left the parking.
Registered keeper of the vehicle has now just received a PCN of
£100 (£60 pounds if paid within 14 days) basically because the
car stayed for 22 minutes at the car park and wasn't registered.
Is there a there a good chance for an appeal to succeed for such
a case?
Thanks

I've blurred the timestamps and dates as I don't see how they
could help
I don't have any picture of the signage and it can't be seen
from Google Street View

So you didn't read the link properly?
If you want tailored advice, times and dates are potentially
vital.

Times and dates allow anyone having access to the PCN database
to very easily identify which PCN it is and therefore which
vehicle etc. As I already stated, I don't see how they could
make any difference for this case which is why I deliberately
blurred them

The entry and exit times are still fully visible in 2 locations,
on the photos as time stamps and above the photos in text.
The key missing information is the date it was sent but seeing
as event was the 28th of September and you started a post here
on the 8th of October Im going to go out on a limb and say the
PCN is POFA compliant in which you admitting to being the driver
here isnt really going to be a major issue as you will be haeld
liable as keeper anyway. This will play out as follows:
You will appeal, unless you can come up with a more substantive
defence than above it will be rejected.
You will appeal to POPLA with the same outcome.
You will get debt collectors letters for a few months.
You will receive a letter of claim.
If that is from DCBL Legal you will have to through the dance of
providing a defence and taking part in meditation. It will
probably get dropped before court.
If the LOC is from Parkineye it probably will go to court.
On the balance of probabilty with your current defence you will
lose.
You then pay the increased invoice value or they issue you with
a CCJ which will screw up your credit rating for 7 years.
Do you want to wade through the process for the next six months
and hope its DCBL Legal or do you want it gone from your life?
None of the above is guaranteed but it is the usual process.

All good except that a "CCJ" does not harm your credit rating
unless it is not paid in full within 30 days. Please don't say
that it does, too many people already misunderstand this. The
CCJ is the judgment and that's all; it's the entry on the
Register of Judgments, Orders and Fines which is important, and
this entry will be for six years unless the judgment amount is
paid in full within 1 months, in which case the entry can be
removed.

Thought Id been fairly clear about pay post judgement or the CCJ
will screw up your credit rating but I take your point.

If you're concerned that ParkingEye might be browsing this forum
to try and undermine you - ParkingEye issued around 2.5 million
PCNs last financial year. That works out at roughly one every 12
seconds, 24 hours a day, 365 days a year. They're unlikely to
waste much time trying to catch people out on this forum.

Is this hotel on the airport land?
