       SIXT paid UKCPS parking charge before I could appeal

       Hi all, first time posting here. I originally posted about this
       on Reddit and a few people advised me to come here for more
       specialist advice, so hopefully someone can help me understand
       this a bit better.
       I rented a car from SIXT and received a UKCPS private parking
       charge at Abbey Wood Shopping Park for overstaying the 4-hour
       limit by 43 minutes.
       I accept that I overstayed. I’m from Singapore and I’m also used
       to driving in Malaysia, where from my experience I wouldn’t
       normally expect an open car park with no barriers to be
       monitored in this way. So I genuinely didn’t realise how these
       free private car parks work in the UK. Lesson learnt!
       I was at one of the businesses there the whole time and was
       planning to appeal, but before I had the chance, SIXT had
       already paid the £60 charge and then charged my UK debit card
       £100 (£60 + £40 admin fee).
       What I’m trying to understand is why SIXT paid it rather than
       passing my details to UKCPS as the hirer and allowing me to deal
       with it myself.
       SIXT’s terms say they can recover “the fine or charge itself (if
       we have to pay it)”, while my rental agreement specifically
       mentions parking charge notices and the Protection of Freedoms
       Act 2012.
       So did SIXT actually have to pay this private parking charge, or
       could they have transferred liability to me and allowed UKCPS to
       pursue me directly? And now that they’ve paid it, is there
       anything I can realistically do about the £60 and/or £40 admin
       fee?
       I’ve attached redacted copies of the original UKCPS notice sent
       to SIXT, the SIXT invoice and the relevant part of my rental
       agreement.
       Any advice would be really appreciated.

       In theory Sixt could (and should) have provided the requisite
       documents as provided for by PoFA to transfer liability to you -
       they did not need to pay the invoice, and accordingly, have
       seemingly done so voluntarily. One issue you'll have is you
       can't simply refuse to pay and let them take you to court, as
       they've already debited your card. You'd therefore either need
       to pursue a chargeback with your debit card provider, or sue
       Sixt.
       Do you have a more thorough/complete agreement? From the one
       pager you've shown us, I'm struggling to see where the £40 admin
       charge has come from, notwithstanding all of the above.
