PCM PCN Confusing location/timescales

Got this from PCM in the post on 17/9 - 6 days after the date of
issue (11th). No date stamp on envelope.
Just wanted to ask advice as to whether or not it's fully
compliant with PoFA. The notice gives 14 days from the date of
issue, which was the 11th to pay at the reduced rate, if it's
not paid by then the full amount is due. The PCM website also
states there are 4 days left from today (21st) to pay the
reduced amount which means it has to be paid by the 25th which
is 2 days less than it should be as it does not take into
account any days for postage. The 11th was a Friday so that
means the next working day for delivery would have been Tue15th
(got it on 17th no date stamp on envelope).
The notice then states 'if after a period of 28 days beginning
with the day after that on which the notice is given'. This is
very confusing as I'm not sure what they mean as it's not
clearly stated.
The notice states the reason for the parking charge being issued
as: Permit Holders Only (ANPR). It says the vehicle was parked
on private land in breach of terms and conditions at
Silverworks, Grove Park London NW9 ODD. There are no photo's of
the vehicle parked anywhere, the same 2 photo's are on the
notice and their website showing the vehicle being driven on a
road and beneath the image it says Silverworks.
On the notice it states the location as Silverworks, Grove Park
NW9 0DD. It doesn't give an exact location, this is very
confusing as NW9 0DD is the postcode for the road called Grove
Park which is a public highway which is regulated by the local
authority of Brent Council which would surely mean that PCM have
no authority to issue a parking charge for that road. You access
Silverworks Close from Grove Park.
Silverworks is a development split into 6 seperate blocks/areas
which are all accessed via Silverworks Close. All 6 areas have
different post codes within Silverworks Close: NW9 0FB, 0FA,
0FG, 0FD, 0DW, 0EE.
So, can I appeal on these two grounds as the notice doesn't
fully comply with PoFA? Have uploaded NtK both sides and
screenshot of PCM Website.

Yes the postcode does appear to be a public highway as it
encompasses Grove Park. There appears not to be a period of
parking. If photographs of the sign’s were available this may
assist.
You can appeal that the PCN does not comply with POFA as the
registered keeper.

How big is the 'Silverworks' development? Any argument about
failure to specify the relevant land as per PoFA may well depend
on the size of the apparent site (although an incorrect postcode
may also help).

There's an entry and exit time, and a duration. Arguments about
consideration and/or grace periods notwithstanding, it'd be an
uphill battle to argue they failed to specify the period of
parking.

Don't know actual size of development but have added link to
overview of it. Also pics showing approach to Silverworks Close
from Grove Rd and signage in Silverworks Close.
Is there any appeal points in the confusing timescales for
payment?

Whether the entry sign provides sufficient information to warn
any driver is debatable as it does mention that there are signs
available further along. However I have looked at some other
sites and This particular close has the post code OFD amongst
others so the specific postcode may not be accurate.
It would possibly be stretch to put forward entry and exit ANPR
times if 20 minutes has elapsed but in my opinion it does not
give an accurate period of parking.

So, there's no realistic argument in the fact that Silverworks
Close is private land and Grove Road is enforced by Brent
Council and is not private land?

If there is a specific post code Silverworks close and they have
not used that it may well void the charge. As accuracy is
important when you enter into a contract. Ultimately it may be
for a court to decide. You can appeal and see what they say.

In the Silverworks development there are 6 areas divided into
various apartment, houses and terraces each coming under their
own name ie: Trent House, Woodcroft Apartments, Barnham Terrace
etc, but all 6 are listed as being in Silverworks Close and each
one has a different postcode within Silverworks Close, as listed
above. None of the postcodes relate to Grove Park, the postcode
for that is NW9 0DD as stated on the NtK and this road falls
under the jurisdiction of Brent as it is a public road whereas
Silverworks Close is private land.Do you think this would be a
credible appeal point?

Of course you need to appeal in order to ensure that any parking
charges are issued correctly if not they should be withdrawn in
the interests of fairness. Although fairness is not the primary
objective of the parking company.

Was going to submit this appeal to PCM today, would appreciate
advice on whether my reasons for appeal are valid. Thanks.
I am appealing this parking charge as the registered keeper as
the notice is not fully compliant with PoFA 2012 for for
following reasons:
1. The location stated on the notice is ambigous. PoFA 2012
states:
9(1) A notice which is to be relied on as a notice to keeper for
the purposes of paragraph 6(1)(b) is given in accordance with
this paragraph if the following requirements are met.
(2)The notice must—
(a)specify the vehicle, the relevant land on which it was parked
and the period of parking to which the notice relates;
The notice states the reason for the parking charge being issued
as: Permit Holders Only (ANPR). It also states that signage is
clearly displayed throughout the area. It says the vehicle was
parked on private land in breach of terms and conditions at
Silverworks, Grove Park London NW9 ODD. There are no photo's of
the vehicle parked anywhere, the same 2 photo's both on the
notice and the PCM website show the vehicle being driven on a
road and beneath the photo's it says Silverworks.
The notice states the location as Silverworks, Grove Park NW9
0DD. It doesn't give an exact location, this is very confusing
as NW9 0DD is actually the postcode for the road called Grove
Park which is a public highway that comes under the statutory
authority of the London Borough of Brent. This road is not
private land therefore PCM have no authority to issue a parking
charge for that road.
Silverworks is a development split into 6 seperate blocks/areas
which are all accessed via Silverworks Close. All 6 areas have
different post codes within Silverworks Close: NW9 0FB, 0FA,
0FG, 0FD, 0DW, 0EE. None have the postcode NW9 0DD.
This is very confusing as it names two seperate locations that
come under different regulations regarding the issuing of
parking charge notices and the signage they quote clearly does
not relate to Grove Park NW9 0DD which is a public road.
2. PoFA 2012 schedule 4 clause 8 states:
NOTE 2: A notice sent by post is to be presumed, unless the
contrary is proved, to have been delivered on the second working
day after the day on which it is posted; and for this purpose,
“working day” means any day other than a Saturday, Sunday or a
public holiday in England and Wales. Therefore, parking
operators must retain a record of the date of posting of a
notice, not simply of that notice having been generated (e.g.
the date that any third-party Mail Consolidator actually put it
in the postal system.)
The notice gives 14 days from the date of issue, which was the
11/9/26 to pay at the reduced rate of £60.00, which means it
would have to be paid by the 25/9/26, if it's not paid by then
the full amount is due. The PCM website also states there is 1
day left from today (24/9/26) to pay the reduced amount which
again means it has to be paid by the 25/9/26 which is 4 days
less than it should be as it does not allow any extra days for
postage. The 11th was a Friday which means the second working
day for delivery would have been Tue15/9 (but actually received
it on 17th no date stamp on envelope). This means the last date
for payment (14 days from 15/9) at the reduced amount should be
29/9/26.
I would therefore ask that this parking charge be cancelled for
the reasons stated.
I have uploaded a screenshot of your website taken today showing
that there is 1 day left to pay the reduced amount.
