You should also include ccbc@justice.gov.uk as
ccbcaq@justice.gov.uk has been known to lose things. If you
have an email address for the claimant include that in the cc
field as well and add the claimant's reference

Did you inform the PPC once you received the PCN that you had a
valid Blue Badge? If so, and if you haven't sent the defence
yet, I'd suggest maybe adding the following paragraphs:
5. Under the Equality Act 2010, the Claimant, as the car park
operator, has a legal obligation to make a reasonable adjustment
to accommodate the needs of the Defendant as a disabled
individual. This includes considering evidence provided by the
Defendant regarding their eligibility to park in a marked
disabled parking bay.
6. The Claimant failed to take reasonable steps to reassess the
situation after receiving evidence of the blue badge, despite
being aware of the Defendants disability-related difficulties
(short-term memory loss and brain fog). As such, the Claimant
has breached their obligations under the Equality Act.
If you've added more than the single paragraph #4, all
subsequent paragraphs must be renumbered sequentially.
You email the PDF attachment with the claim number in the
subject line. Email it to ccbcaq@justice.gov.uk and the claimant
or their solicitor, if they're using one. Also cc yourself.
When submitting a defense in a civil case to the Civil National
Business Centre (CNBC), it is advisable to also send a copy to
the claimant or their solicitor. While the CNBC may indeed send
a copy to the claimant or their solicitor as part of the normal
process, it is best practice to ensure that all parties receive
a copy of the defence directly. This helps to avoid any
potential delays or misunderstandings in the communication
process. Additionally, it demonstrates transparency and
adherence to procedural fairness.
