Okay, so there is no way that the NtK is POFA compliant as the
wording required by POFA Schedule 4 Paragraph 9(2)(f) is not
present and therefore keeper liability cannot be established.

Have you approached the venue for help on this?

Exactly, and even in my appeal I didn’t mention that I was
driving or someone else, I just said “we”.

No, but I can go today, the only problem is the venue has many
things inside, cinema, nandos, restaurants, and then there is an
indoor play area and ten pin bowling. That’s where we went on
that night. I can go and speak with them but I am sure they will
just say to appeal the notice, but I will try.

Any receipts and/or booking confirmations for these? That,
combined with your and your partner's accounts of the fact that
you were using the bay to collect a child would seem to paint a
pretty strong picture. The signage says you must be
'accompanied' by a child to use the parent and child bays - it's
unclear whether that means you must be accompanied when you park
and when you leave, or just one of those, and in the case of an
unclear term, contra proferentem would seem to apply:
Contract terms that may have different meanings
"If a term in a consumer contract, or a consumer notice,
could have different meanings, the meaning that is most
favourable to the consumer is to prevail."
I don't have receipts as we were just there to pick him up, as
he was there with his aunt playing games that you can play using
coins. But I have some pictures of him playing there. I
challenged the PCN with the wording that I put above; if they
don't accept my appeal, what is the best option for me, please?

The appeal as you say has been submitted they may deduce the we
as the RK unless you specifically mention I then thus would be
difficult to prove.
Next step is to await the outcome and then possibly escalate the
appeal. You will have to await their decision more often than
not appeal refused.

No I never said I, only used the word “we”. I included the
appeal message in one of the previous comments. Will update you
on the outcome and we can take it from there. Thanks for the
support guys, finger crossed.

Since they want your money, most likely they will refuse your
appeal. They are with IPC, so secondary appeal will be to IAS -
who will almost certainly also reject it (because they work for
the parking co's and reject >95% of appeals.
ES will then chase you for payment, adding a £70 'debt recovery
fee', and sending increasingly shrill and threatening warnings
letters. Eventually a court claim will be lodged, when there
should be a good chance of winning, or, as long as you defend
it, they will bail out before they have to pay the trial fee.
So when they reject the appeal, and re-offer the discount as a
'gesture of goodwill' you have to decide whether to pay to make
it go away, or weather the storm of letters and be ready to
defend it at court and most likely pay nothing.

What would you say, what’s the best thing to do, if I end up at
the court, do I have good chance of winning?
Secondly, if I don’t pay and they keep sending me letters, can
that affect my credit score? Thanks
