Code 30 - Parked for longer than permited

I have received a PCN for code 30.
I live on a section of the road where several local businesses
operate, which I understand is why the parking restriction is in
place. However, one of the buildings at the top of the road,
which also accommodates one of these businesses, contains four
residential flats. Before moving into my flat, my landlord
informed me that I did not require a residents’ parking permit
and that I could park on the road. I relied on this information
and have been parking there for the past nine months without
receiving any previous fines or warnings.
Following receipt of this PCN, I investigated whether I could
obtain a residents’ parking permit to ensure that I was parking
lawfully. I have since established that my property is not
eligible for a residents’ parking permit and, as far as I have
been able to establish, there are no neighbouring streets where
residents of my property are eligible to use a residents’ permit
either.

Why do you think the PCN can be challenged? It looks like a
solid contravention of overstaying the 1 hour bay.

Odd that this parking has been tolerated for nine months before
a PCN was served. The only thing I can think of at the moment is
'legitimate expectation' as you have parked there for so log
without penalty.
Please post the back of the PCN, because it must contain a
certain message and if it doesn't you can claim it is void.

The message is the bit about when you do not pay or challenge.
It has to contain a certain item of info that is mandatory.
Unfortunatley for you, this is present and correct

GSV June 2024 shows that the majority of the road, that is from
Gladstone to Cromwell, is unrestricted. The CEO photo which
shows this length in the background suggests that it's still
unrestricted e.g. no parking place markings etc, and the number
of cars would seem to confirm this. So when your landlord said
that you could park in the road, they were correct. You just
cannot park without limit in your section.

But if that’s the case, will the council not allow residents to
apply for residents parking permit? I understand that there is
unrestricted parking on the roads in my vicinity, but those are
dedicated for the residents living on those roads.

If there are no parking bays and parking signs the only way
kerbside can be restricted is with a permit parking area or
restricted zone of some sort with entry signage. This does not
seem to be the case in your area so if you keep out of that 1
hour parking bay you'll be fine.

But there is unrestricted parking in your vicinity, it starts no
more than 30m from where your car was parked and extends from
Gladstone to Cromwell. What you appear to want is restricted
parking, that is to holders of specified permits, and for you to
be eligible for such a permit.

The only body which can give a definitive answer is the council.
As regards the PCN, as mentioned by Incandescent 'legitimate
expectation' seems to be all that's available. But you would
need detail even if only circumstantial e.g. lived at ** for **
and travel to work by ** therefore leave my car parked in Mount
Road, normally outside my property in the parking bays; this is
the first PCN in that time etc. Or whatever facts fit.
I suggest you post a draft here before submitting.
