PCN Townley Rd junction with Calton Ave (Northbound)

Similar to another recent post, I received a PCN as a result of
turning from Calton Ave into the Townley Rd bus gate (East
Dulwich) in the operational hours between 8 to 9am on the Aug
bank holiday Monday. My notice dated 4th Sept so I have to the
18th Sept to object.
Objection 1. My charge notice has the erroneous text regarding
the Charge Certificate period beginning with the date of the
notice rather than the date of service.
I plan to use the objection text from the recent post that you
have kindly helped to fine tune.
Possible Objection 2
However, I do also want to consider making an objection about
the fact that this was issued on a bank holiday. I have yet to
locate the TMO (and need to find that somehow if one of you have
it) but I am sure that there is no need for this to be
operational on a bank holiday. The layout is labelled as a bus
gate but it is essentially a School Street with the design set
to accommodate the school coaches that arrive for the private
school on Townley Road or around to JAGS on East Dulwich Grove.
The timings of operation of the bus gate is in line with school
hours and the presence of significant parking bays for the
school transport coaches is evidence of its focus on school
transport. Local public buses do not travel down Townley Road.
It is self evident that when you arrive on a bank hol Monday at
this junction, there is no major, if any traffic. Also with
regard to the Calton Rd junction, buses could never access from
that turning to Townley Rd because the access to Calton Ave from
Dulwich Village has been removed and limited to a cycle route.
They can only travel along Townley Rd.
I would be interested to hear you feedback as to whether it is
worth adding point 2 or whether to simply focus on the incorrect
wording of the PCN.

Councils can choose not to enforce CCTV-detected contraventions
on Bank Holidays, (few do as they like the penalty money), but
if the signs don't exempt Bank Holidays then this is not a valid
reason for the PCN to be cancelled, I'm afraid. Saying in
representations that it was a Bank Holiday and no traffic or
children were about is mitigation. Only the council can decide
to accept reps based on mitigation; adjudicators at London
Council cannot.
