Claim Form -- DBC Legal + National Parking Control ++ Parked
without a cashless payment session - Winnersh Triangle
   DIR By: Tim

       ---------------------------------------------------------
       Good Evening all,
I have now received a Claim Form from the Civil national
business centre from DBC Legal for a parking event last year.
In November of last year, the vehicle (of which i am the
registered keeper) was parked in Winnersh Triangle, payment is
       via the RingGo app.
Due to no signal being available there was a delay between
parking and payment being taken on the ringgo app, payment for
the full parking event did get taken though.
It would seem, between the parking, and payment the car park was
visited and photos were taken of the vehicle and a PCN was
       received.
An appeal with the payment reference/invoice was submitted on
the 24th December, and an email was received from NPC saying
       they had received my appeal.
       Timleine is as follows:
       date of contravention: 11/12/25
Date of PCN - 11/12/25 (£100 reduced to 60 if paid in 14 Days)
       appealed - 24/12/25
Notice of Debt Recovery - received 13/3/26 - (now £170)
Letter before Claim -- June 2026
Claim Form -- dated - 07/09/2026 served 5 days later
Need to reply by 26th i believe 14 days
       after the 12th

"costs" are now 264.56, £179.56 Claim, 35 Court Fee and £50
       legal representative costs..
I assume i now reply with the Acknowledgement of Service, (AOS?)
before the 26th, but do i need to put in a defence then before
the end of 28 days? or do you do both the AOS and defence at the
       same time?
and would i be right in assuming that the defence should be as
       the one by B789 here?

       Many thanks for the help

You have to submit an Acknowledgment of Service or a defence by
       4pm on 28 September.
If you submit an AoS then it extends the defence deadline until
       12 October.
That defence has been struck out by the courts as invalid
because it's a boilerplate/template thing which moans about the
process but says nothing about your particular circumstances.
Your defence should address the NtK and the Particulars of Claim
and explain why you are not liable to pay under the contract the
driver entered into by reading the signs and by parking.
What did your appeal text say?
Why did you not receive a response to your appeal?

       Hi,
annoyingly i took a screenshot of the appeal, but i cannot find
it, it was along the lines that parking for the event was done
through the App, (there is incredibly spotty cell coverage at
the carpark) and I attached the invoice from RingGo as proof the
parking had been paid, parking was made for 8 hours, which is
the maximum period at the car park, I replied as the Registered
       Keeper.
       I submitted the defence on the 24th December @ 10:00, so i
assume that Christmas / new year got in the way for them, i
checked Spam but didn’t get anything back from them at all.
As such i didn’t get a code to take it to the other one to
POPLA, the next correspondence i got from them was the letter of
       claim in June.

Does this mean if the NPC and further correspondence doesn't
follow the legislation of the POFA you cannot use that?

That's the car park sign, assume its fairly standard..
I will look to respond to the AoS by next week to give me the
extra time to submit a further defence.

Hi All, i realise i now have to submit the defence by 4PM
Monday, How does something like this sound?
       1. I am the Defendant in this claim. This witness statement is
made in support on my defence.
       2. On the 11th December 2025, DG19 PYT entered the car park at
Winnersh Triangle, a parking event was started using the RingGo
app, payment reference: NPCGLRW-2025-12-11-00277. This payment
covers the car park for the full 8 hours of operation, the
       maximum payment of £5.10.
       3) The fact that i have a receipt for the days payment was
ignored by NPC after i appealed the initial (non compliant)
Notice to Keeper "NtK". I received acknowledgement of my
appeal, but no further correspondence or opportunity to appeal
to an independent 3rd party (PoPLA/AIS).
       4) NTK Non Complience ------ Is it? i am not 100% of this?
       5. The Defendant denies the claim in its entirety. The Defendant
asserts that there is no liability to the Claimant and that no
debt is owed. The claim is without merit and does not adequately
disclose any comprehensible cause of action.
       6. There is a lack of precise detail in the Particulars of Claim
(PoC) in respect of the factual and legal allegations made
against the Defendant such that the PoC do not comply with CPR
       16.4.
       7. Pursuant to Sch4 of the Protection of Freedoms Act 2012
('POFA') the claim exceeds the maximum sum and is unrecoverable:
see Explanatory Note 221: 'The creditor may not make a claim
against the keeper ... for more than the amount of the unpaid
parking related charges as they stood when the notice to the
driver was issued (para 4(5))'. There is no keeper liability for
added false fees and the POFA specifically states that 'double
recovery' is not allowed if a creditor uses any other remedy.
Any help will be much appreciated.
