TfL CCTV PCN Code 46 – Moffat Road SW17 – briefly stopped
because vehicle was blocking road

TfL – Moffat Road SW17 – Code 46 CCTV PCN – temporarily
prevented from proceeding
Hi all,
I would appreciate some advice on a TfL CCTV PCN before I submit
representations.
PCN details
[*]Authority: Transport for London
[*]Contravention: Code 46 – Stopped where prohibited (on a red
route or clearway)
[*]Location: Moffat Road, south side near its junction with
Upper Tooting Road, SW17
[*]Date: 31 August 2026
[*]Time: 13:56

What happened
I remained in the driver's seat throughout.
Another vehicle was obstructing the road / had left insufficient
room for me to safely proceed.
I therefore became temporarily stationary while waiting for
sufficient space to proceed.
I was also preparing to reverse slightly in order to give the
other vehicle more room.
Once there was sufficient room to proceed safely, I moved away.
TfL's CCTV evidence
TfL has only made three still photographs available on the PCN
website.
The photographs are timed:

[*]13:53:36
[*]13:56:08
So the period covered by the still photographs is approximately
2 minutes 53 seconds.
The CCTV angle shows my vehicle and the bay, but it does not
show the relevant section of road ahead of my vehicle where the
obstruction was.
In the closer CCTV photograph, the white reversing lamp is
illuminated.
I had selected reverse because I was preparing to move backwards
slightly to create additional room for the other vehicle.
The driver's window is also open.
My point is therefore not that the vehicle was never stationary.
It plainly was.
My point is that it was temporarily stationary because I was
unable to proceed safely, rather than being parked or
voluntarily waiting in the bay.
The CCTV photographs show my vehicle but, because of the camera
angle, they do not show the circumstances that caused me to
stop.
Current sign
I have now checked the actual current sign governing the bay.
It states:
No stopping Mon-Sat 7am-7pm
Except 10am-4pm
Loading max 20 mins
So I am not disputing the signage.
The stop occurred at around 13:53–13:56, so this was during the
period when the bay operates as a loading bay.
Full CCTV footage
There is no video available to play on TfL's PCN website.
TfL only displays the three still photographs referred to above.
I intend to request access to the complete approved-device
recording, including footage immediately before, during and
after the period shown in the still photographs.
This seems particularly important because the still photographs
do not show the road ahead of my vehicle.
Possible exemption – prevented from proceeding
My understanding is that the applicable Traffic Management Order
should contain an exemption where a vehicle is:
"prevented from proceeding by circumstances beyond the driver's
control"
I have also found the following adjudication:
GSL Ltd v Royal Borough of Kensington & Chelsea
PATAS case 2060175326
My understanding is that the vehicle in that case was prevented
from moving because of traffic conditions and the adjudicator
accepted the relevant exemption.
Obviously another adjudicator's decision would not be binding,
but it appears potentially relevant to the principle involved
here.
Reversing lamp
One point I would particularly appreciate views on is the
illuminated reversing lamp.
The close CCTV photograph appears to show the reversing lamp
clearly illuminated.
That is consistent with my recollection that I had selected
reverse because I was preparing to move backwards slightly to
give the obstructing vehicle additional room.
I appreciate that a reversing lamp by itself does not prove why
I was stationary, but I wondered whether it provides useful
contemporaneous evidence that the vehicle was being actively
manoeuvred / remained under the driver's control rather than
simply being parked.
Loading
For completeness, the premises adjacent to the bay are connected
with my business and I do sometimes deliver stock there.
I later returned and unloaded stock into the premises.
However, I do not intend to rely upon loading as the explanation
for the particular stop shown in these CCTV photographs.
I want the representation to accurately reflect what happened.
My case regarding this particular stop is that I was temporarily
prevented from proceeding because of the other vehicle / traffic
situation.
I have not yet submitted representations.
I would particularly appreciate advice on:
[*]Is the "prevented from proceeding by circumstances beyond the
driver's control" exemption the correct ground to rely upon?
[*]Does the illuminated reversing lamp provide useful evidence
supporting my account that I was preparing to manoeuvre?
[*]How significant is the fact that TfL's camera does not show
the vehicle / obstruction ahead of me?
[*]Should I obtain the complete CCTV recording before submitting
my representations, or submit the representation and CCTV
request together?
[*]Does anyone have the applicable Traffic Management Order for
this exact Moffat Road bay and, particularly, the wording of the
prevented-from-proceeding exemption?
[*]Is GSL Ltd v Royal Borough of Kensington & Chelsea, case
2060175326 relevant/useful here?
[*]Is there anything else in the PCN or TfL evidence that I
should be looking at?
I will add links below to the three CCTV images, the close-up
showing the reversing lamp and the current sign.

Ask TfL for the video.They will send it as a DVD, (yes, they're
in the IT Dark Ages). They will freeze the process for about 10
days. If you don't receive it within that period contact them
again.
The video should confirm your narrative.
