Code 27 - Redbridge (driveway)

Brother has received a rejection in relation to a PCN appeal for
parking on a driveway in which he had permission to do so. Don’t
have a picture of original PCN but was the yellow ticket on the
car. I assume would be same format as PCN I had received (please
see link to thread:

I don’t have wording for original appeal but the main point was
that he had permission to park there.
Background - We have permission from our neighbour to park here
and I have now got a signed letter from him confirming this
which I will include in appeal to ETA. Someone has obviously
complained but it is not their driveway so they have no right.

If you haven't got the PCN, then please post the full text of
the alleged contravention. You should submit a photo-copy of the
neighbour's letter; never, ever, trust councils.

The letter is outright misleading tosh!
Wait for the advice of others who can examine your thread in
more detail. I consider yr brother has grounds to appeal to LT,
so do not miss deadline to register appeal (rejection dated 18th
August)

OP, where is the occupier's written authority pl?
Register an appeal. Let's not waste too much time on this IMO.
The NOR is about as bad as they get with multiple procedural
improprieties.
Just register:
Contravention did not occur;
Procedural impropriety.

What accompanies this letter to prove that the writer has the
authority they claim e.g. council tax bill, utility bill (in the
same name) etc?

Feel like I shouldn’t have to submit this? Council can verify
his name against their records.

Could have been written by anybody who knows thr name of the
neighbour.
Needs to be accompanied by soemthing only that neighbour would
possess in order to prove it was written by the neighbour (eg
council tax bill)

Have got an appeal date for 12th April 2027 - Thinking I should
have done postal to get it out the way sooner!
Is it worth asking for it to be changed to a paper determination
or is that not worth it?

If heard on the papers then the adjudicator could only go on
written evidence, snd IMO yours is deficient unless there's
something which proves to the required standard that the author
of the permission has the legal status required to grant the
exemption.
I have not read any tribunal decisions on this point so don't
know what an adjudicator would need. The words of the Act are:
3)The second exception is where the vehicle is parked outside
residential premises by or with the consent (but not consent
given for reward) of the occupier of the premises.
This exception does not apply in the case of a shared driveway.
No mention of consent in writing, even less written consent in
advance. But you knowing and acting upon such permission is one
thing, convincing an arbiter is another. This is an appeal and
absent the occupier presenting oral evidence you're left with
what's written. What supplementary questions might the
adjudicator have in their head which you might not have
anticipated in your written submissions?
On the whole we favour personal hearings.
