Bus Lane Contravention

Hi all,
Hope you're well?
I have had a fine today with being in a bus lane, by 1 min, I'm
aware there is probably nothing that could be done.
But just wanted to check if that was the case by those that may
be in the know.
It would appear I was already in the lane at the first part then
as I have moved to the second part I was then over the time.

Considering the contravention only occurred 1 minute into the
restricted times, I’d say you have a very strong case in this
situation already, and can win possibly alone on De Minimis, as
a car clock cannot be expected to be atomic and display the time
exactly. The Act they use to enforce bus lanes is also very
advantageous, as many appeals are won alone on Schedule 1,
Paragraph 7(6) of the London Local Authorities Act 1996, as the
authority does not attend which means an automatic win.
Currently, I believe an appeal solely based on De Mimimis will
be good enough to the authority, the rest can be left for the
Tribunal if they reject.
Let’s leave time for others to comment.

The clause in Schedule 1, Paragraph 7(6) of the London Local
Authorities Act 1996 has won quite a few appeals now, and it's
puzzling that the councils don't turn up. Of course you would be
risking the full PCN penalty, and never know if they are going
to turn up or not until the day of the adjudication.
I suggest you submit reps on the de minimis grounds as Bulop
suggests. They will no doubt reject them, and then, if you want
to take the gamble, you can submit the same reps to the
adjudicators at London Tribunals and also request attendance as
the Act requires.

Thank you Incandescent. Appreciate the help. Knowing my luck
they'd bloody well turn up, but like you say it's a gamble if it
reaches that point.
Will appeal and see what they say.
Is it worth that money for a council to send someone to
represent, who knows.

Well it’s not a lawyer who has to turn up! It’s the camera
operator who observed the offence, who is meant to be working,
so even less likely for them to attend. Besides even without the
attendance clause there is the fact they need to have a valid
VCA certificate for the camera, but those are all for the
Tribunal. De Minimis can again be used as a ground for Tribunal
and some adjudicators have allowed solely based on it so there
is a good chance of this appeal succeeding regardless of whether
they attend.

I just saw the photo evidence, not the video.
This is another one of the rare cases, I've seen just another
one recently, where the evidence provided by the authority
(photo) actually shows upright signage passed and in place.
