Euro Car Park PCN for overstaying the maximum time period
despite using EV Chargers

Hi there,
I have a company EV car and just had an email that I have
received a PCN of £100 (£60 if paid early) for "Your vehicle has
overstayed the maximum time period allowed".
The notice is from Euro Car Parks and shows my entry time X date
at 00:33 and exit time X date at 00:53 for a time period of 0
Hours and 20 Minutes and 20 Seconds.
I was mortified to see this fine as the car park is a Morrisons
with 8 high speed EV chargers. I was on my way back from a long
drive and low battery so nipped in for a quick top up before
heading home. I have the charging receipt which shows charging
time 00:35 to 00:53.
I went back today because I genuinely had not noticed any signs
up for parking restrictions (may be because it was late) and
noticed there are a fair few signs that state "2 hour parking
between 5am and 11pm" "Max stay 10 mins between 11pm and 5am",
however, there aren't any signs around the EV chargers stating
that they cannot be used.
I understand it may be a case of me being an idiot and assuming
(bad idea) that because the chargers are available 24/7 that I'd
have a right to charge there. But, do I have any case to appeal
this or do I just need to lump it on this occasion and accept
the charge/move on.

It's probably a 'no parking out of store hours' carpark. Which
is a bit daft if it's got 24h charge points in it! Morrisons
are generally good at getting PCNs cancelled in their carparks
for customers, but in this case it may not be their land /
chargers?
What exactly is your relationship to the car and its reg keeper?
Presumably no PCN in your name, but if you have an option best
to avoid the keeper naming you as driver.

First off, you need the lease company to follow the instructions
on the NtK and nominate you as the vehicle hirer.
You cannot appeal in someone else's name.
Was the PCN in your name? Please post up the PCN.

Thank you, both for the quick reply!
It's not in my name no, so I have a third party authorisation
letter if I wish to appeal.
EDIT - attaching image links (I've blurred out lease company and
reg). I've also included a photo I took today of the parking
sign (I charged late at night so couldn't see this sign and
there isn't one directly near the chargers but they are dotted
about).

Sorry, I should have been clearer - who is the PCN actually
addressed to?
Is it the lease company or is it the hirer?

Oh apologies!
It was addressed to the lease company. My name doesn't appear
anywhere.
The lease company emailed me the PCN and a third party
authorisation letter if I wish to appeal.

Okay - so what you need to do is to go back to the lease company
and ask them to follow the instructions set out on the back of
the PCN.
They will nominate you as the hirer of the vehicle.
ECP will then have to issue an NtH (Notice to Hirer) addressed
to you.
ECP will screw this bit up and send you an NtH WITHOUT the
supporting documents required under Protection of Freedoms Act
2012.
This means that they won't be able to transfer liability for the
charge onto you.
This is a slam-dunk at the POPLA stage.
Also note the MFG specify on their website that this site offers
24 hour charging access.

This site also offers other facilities which operate outside of
store hours such as Amazon Lockers.
This brings this issue firmly under the umbrella of the CMA
investigation which the CMA are currently carrying out on ECP
and you should therefore submit your evidence to the CMA
outlining the potential breaches of consumer laws.

These “third party authorisation” letters are complete rubbish,
they are a collusion between the leasing companies and the
parking companies to avoid their legal requirements.

That's amazing, thank you!
Just on this bit "Okay - so what you need to do is to go back to
the lease company and ask them to follow the instructions set
out on the back of the PCN."
Apologies if I sound stupid, do I just need to ask them to
follow the instructions on the back or specifically mention
"Please follow the instructions on the back of the PCN and
notify ECP of the hirer?
The reason I ask is the lease company sent me a separate
document that states the following
"If you’d like to challenge this, please do this directly with
Euro Car Parks Limited. You have 28 days from the fine issue
date and
instructions on how to appeal on the notification. We can’t
appeal on your behalf as we're not the driver, so we've attached
a
‘Third Party Authorisation’ letter that you'll need to send with
your appeal to Euro Car Parks Limited."

You need to tell them that you will appeal as hirer (not as
driver) if they follow the instructions on the PCN and identify
you as the hirer.
