Bus Lane PCN - confusion caused by temporary traffic lights
   DIR By: purple_elk

       ---------------------------------------------------------
       Hi,
I received a PCN for driving in a bus lane, a couple of miles
from my home. I know these roads well and I have never received
a PCN for this kind of thing.
Upon observing the photos they provided as evidence, I can see
that there are temporary traffic lights and a sign saying 'when
red light shows wait here' which made me think that the bus lane
was suspended during the road works.
Please find attached PCN (redacted) and photos. I am curious to
know if I can appeal on the grounds that it was ambiguous
whether the bus lane was operational, due to inadequate signage?
Please and thank you and love to all

So, there is a long queue of traffic with the temporary traffic
lights showing green, but you decided to drive down the clear
bus lane instead ? There is nothing on any of the signs to
indicate the bus lane is suspended.
Frankly, I don't think you have a strong case but see what the
       others say.

I think the sign saying 'wait here' implies that the bus lane is
suspended, but I'm keen to hear if others see this as a valid
       grounds for appeal

I see two signs, one for bus lane traffic on the left and
another for the other traffic on the right.
Did you join the queue by turning right from a junction, does
that perhaps explain the positioning of your vehicle?

ah that makes sense, so the sign on the right is for busses and
       other bus lane traffic?
Looks like I'm just going to have to pay up

I imagine that reporting the lack - on photo evidence provided -
of any upright 958 warning sign or 959B signage allegedly passed
and in place won't be considered at all by the Council at both
informal and formal representation stages. I can't see the large
white road markings BUS LANE either, but that also normally
       isn't considered.
On the forum we had another case of roadworks on a bus lane,
back in June, and the PCN has been cancelled by the Council.
Anyway it was a very different situation.
