Hi
My husband has recieved a Notice of Debt Recovery 9/7/26
followed by Final Reminder 3/8/26 and Letter of claim
14/8/26. These relate to 2 parking charges from 2022. My husband
recalls it but thought it was resolved because he had paid to
park. hehad a stroke in June 2023 and although hes well
recovered he cant really remember the details.
Should i do an access request as I cant find anything in
relation to it on email /photos etc.
I recently messed up on a defence (missed court deadline) so
DCBL got paid from my address recently, I wonder if thats why
the are trying again.
Advice please

You need to respond to the letter before claim stating that you
deny the claim and get as much evidence as possible. You need to
submit a SAR by following the protocols you can look this up to
see what is required. As soon as you have information you can
come back here.

Hi
I found an email from horizon regarding a different ticket
29/10/22 say the liability had been transferred. I am not sure
why only one was dealt with if he had 3.
I have also uploaded the letters recieved as I notice they only
have 1 photo taken on 2/11/22.

I am writing in formal response to your Letter of Claim
regarding alleged parking contraventions on 25/10/22 and
02/11/22. I deny any and all liability to your client, Horizon
Parking.
I have no record or recollection of receiving any original
Parking Charge Notices (PCNs) or subsequent Notices to Keeper
regarding these two specific dates back in 2022. Please note
that during this entire period in late 2022, the vehicle was
being used for legitimate, authorised commercial work on a
nearby contract site. Indeed, a separate ticket issued by your
client on 29/10/22 and was dealt with promptly at the time,
which proves I am a responsible keeper who deals with legitimate
correspondence immediately.
To enable me to fully understand the basis of your claim and
properly respond, I require you to provide the following
documentation and information under the Pre-Action Protocol for
Debt Claims:
Copies of the original Parking Charge Notices (PCNs) / Notices
to Keeper (NTK) for both 25/10/22 and 02/11/22.
Proof of postage or digital logs showing exactly when these
original notices were supposedly dispatched to the Registered
Keeper back in 2022.
Full photographic evidence of the vehicle showing the alleged
contraventions. I note that prior "Notice of Debt Recovery"
letters contain absolutely zero photographic evidence for the
date of 25/10/22. A claim cannot be maintained for a date on
which you cannot even prove the vehicle was present.
Clarification regarding the evidence for 02/11/22. The single
photograph provided in earlier correspondence merely shows the
vehicle in motion entering/exiting. It does not prove the
vehicle was parked, nor does it account for the mandatory entry
and exit grace periods required under the British Parking
Association (BPA) Code of Practice.
A full, itemised breakdown of the amount claimed. I note you
have added a £70 "fee" to each £85 charge. This artificial
inflation is strictly disputed. Under Schedule 4 of the
Protection of Freedoms Act 2012 (PoFA), maximum keeper liability
is strictly capped at the face value of the original parking
charge. Seeking to recover arbitrary debt collection fees
constitutes double recovery and an Abuse of Process, which
routinely results in such claims being summarily struck out by
the courts.
Please note that you may not assume the Registered Keeper was
the driver at the time of the alleged events. If your client has
failed to comply with the strict timing and text requirements of
PoFA Schedule 4, there is no lawful basis to pursue me as the
keeper.
In accordance with the Pre-Action Protocol for Debt Claims,
please place this matter strictly on hold and confirm that no
court proceedings will be issued until 30 days after you have
provided all the requested documentation and answers above.

Can you confirm (a) where Linenhall Street is, and (b) what
country the keeper is resident in?

Linenhall car park is in Chester. Keeper resides in UK.

Thanks, when i googled I found one in Northern Ireland where the
law is different, hence the question - is the keeper likewise in
England?
