       50mph in a 40mph incoming to Camera, Vehicle exiting and no
       secondary lines on my carriagway

       Hi,
       I am new here so please shoot me down if I have got this wrong I
       am happy to learn.
       I have got a ticket from a camera in Somerset on the A38 the NIP
       say 50mph in a 40mph, this is not a new speed camera and I
       frequently drive past it so either a momentary lapse or a fault
       on the camera, Other people locally on facebook are reporting
       similar issues and wondered there genuinely could be an issue.
       Teh calibration certificate for the camera shows a difference in
       secondary Check Distance Specified 10.2m Distance Measured
       9.83m. The Camera is a Sentio Shield, which I understand does
       not require lines on the road however Avon and Somerset
       guidelines seem to state they rely on sensors or road markings
       for secondary checks, so wondering if this calibration
       difference could be significant.
       Also in the image form the VIP My car approaching the camera is
       almost side by side to a vehicle driving away from the camera,
       there are road markings on the side driving away but not on the
       approaching side.
       Just wondering id two vehicles side by side, lack of markings or
       calibration differences in anyway amount to a defence?

       Probably not.
       But the bottom line is that the device is assumed to be reliable
       and accurate unless the contrary can be proved. The burden to
       provide that proof rests with you.
       It is unlikely that you will be able to present an argument
       which has a chance of success without expert help. You will have
       to pay for that and if you are unsuccessful, you will have to
       pay for the prosecution’s expert, who they will almost certainly
       hire to counter yours.
       Depends if you want to risk a bill of a least £1,000 (and
       possibly much more, plus your own costs) against a certain £100
       for a course or fixed penalty.
