Hillingdon Council Bus Lane - 8 Seconds over bus lane start time

Hi all,
As title suggests, PCN recieved due to being in a bus lane. Bus
lane hours are from 4PM to 7PM. I am on video in the bus lane at
16:00:08. Im guessing there must be some leniency allowed due to
it literally being only 8 seconds over the start time, with
different clock timings etc. Hope to hear your thoughts.

It doesn't appear they've listed all the grounds of formal
appeal accurately at the front. It should include:
The grounds referred to in sub-paragraph (1) above are—
(a)where the penalty charge notice was served pursuant to the
said section 4 or, where an enforcement notice was served, that
the recipient—
(i)never was the owner of the vehicle in question;
(ii)had ceased to be its owner before the date on which the
penalty charge was alleged to have become payable; or
(iii)became its owner after that date;
(b)that there was no breach of an order or regulations of the
type described in subsection (2) of the said section 4;
(c)that at the time the alleged breach of such order or
regulations took place the recipient was not in charge of the
vehicle.
They have stated that "the vehicle was being used without the
owner's consent", but there can also be a driver who has been
given consent by the owner to drive if the owner was not in
charge of the vehicle, so it's a bit inaccurate.

Actually it is more serious than that:
1. The PCN has been paid is a wrong ground.
2. Final statement says they will serve an Enforcement Notice of
not ppaid and this flies in the face of the law.

Would be worth going to Tribunal over it, as the council have
committed some major procedural improprieties. Also any bus lane
penalty using the LLAA 1996 is winnable in any case in the fact
that if the camera operator fails to attend it automatically
means a win (in many cases they do not attend). You can draft an
appeal based on the procedural improprieties and the fact that
the video footage does not show any upright signage being
passed. Don't forget to also ask for the camera certification,
without it being approved by the State Secretary they are unable
to use the CCTV evidence.
There is also the "de minimis" argument, in the fact that your
car clock cannot be expected to be atomic, but I think the other
points are stronger to use. A combination of them would be
deadly.
