Hey everyone, following up regarding a private Parking Charge
Notice (PCN) at an Airport issued by Times24 UK Limited (an IPC
member).
they asked me to send a copy of the Photo ID section of my
driving licence to "verify the driver against unredacted images
held."
I refused the ID request. Restated the previous Byelaws and POFA
Their Formal Rejection Notice:
They have now sent a standard rejection letter. Interestingly,
they explicitly state that the appeal was declined because the
"additional evidence" (my driving licence) was not provided
within the requested timeframe.
They offered a discounted rate of £60 (or £100 full price) and
gave details to appeal to the Independent Appeals Service (IAS)
within 28 days.
Given that Times24 is under the IPC and the independent appeal
goes to the IAS (which is known for being operator-heavy and
often ignoring POFA/Byelaw arguments compared to POPLA):
Option A: Should I still submit a formal appeal to the IAS
citing the Byelaws / POFA 2012 exception and their GDPR
overreach, just to ensure I have a complete paper trail showing
I acted reasonably?
Option B: Is it better to ignore the IAS step entirely, let the
discount expire, and simply file away the inevitable debt
collector letters until/unless an actual Letter Before Claim /
Court Claim Form arrives?

It’s always advised to appeal to the IAS because if the case
actually goes to court it demonstrates that you have explored
all avenues of resolving the issue without going to court.

But clearly their request for “additional evidence” is nonsense,
you have no need to identify the driver or to provide your
picture, and if they can’t use PoFA 2012 they can’t transfer the
liability from the driver to the registered keeper. You spotted
that they’re just trying it on.

Appeal to the IAS stating byelaws and how keeper cant be liable
etc.
I just appealed 52 airport pcns this week🤣
They rejected 10 but blabbled in their rejection notice they
arent pursuing the keeper. So im just gonna use their own
rejection against them in IAS appeal. Other 42 are pending.
Its not a legal requirement to name the driver and they cannot
assume the keeper is the driver. Its up to them to prove it
which they obviously wont be able to.
Also someone correct me if im wrong but with pcn’s issued under
byelaws, isnt there a 6 month max time limit to issue a court
claim and even then if you were liable to pay the money goes to
the public sector or something and not to the parking operator.

Yes, a prosecution under bylaws has to be brought to court
within 6 months, and if successful the result is a fine which is
paid to the state and not to Times24.
I have no idea what “Reddit” says, and the IAS aren’t likely to
uphold any appeal either, but in the long run this should come
to nothing.

None of the airport PCNs (that I have seen at least) claim to be
issued for breaches of byelaws, they're just regular old private
parking charges to which the usual 6 year limit would apply.
Not directly relevant, but a word of slight caution for anyone
running up very high quantities of PCNs - it doesn't change
liability, but may well change the amount of effort the company
puts in to pursuing you for them, potentially increasing one's
chances of having to turn up to a court hearing to argue your
case.
