Formal appeal - provided evidence of post pregnancy c-section,
hence can not walk and needed to use the road during restricted
hours.
Had an appointment at health clinic (Redbridge Children Centre)
which is situated next to a school, the roads leading to the
school and the health clinic (only way to access) are restricted
for non residents during the proscribed hours.
I shared my mitigating circumstance, my husband drove us to the
clinic, we realised immediately we had gone through a road we
shouldn't but there was no other way as I could not walk.
The rejection refers to NHS guidance that I should not have been
driving, but I did not specify I was driving, the LA used this
as a means to say if I am driving they are not persuaded by my
argument I could not walk. (see paragraph 4 of NOR).

How do I explain to adjudicator and articulate, I was not
driving as per NHS guidelines that new mothers recovering from C
section advised not to drive for several weeks following a C
section. I was not fit to walk or drive, I've also had
complications with recovery.
Any advice on how to formulate the adjudicator appeal statement
would be helpful.

No NOR as you have posted the PCN twice. This is winnable on the
signage: clutter and too set back by the time you realise you
have passed.
I won a similar case very recently v Lambeth.

the Tribunal cannot allow on this. Your best bet is the signage
and conflation of service with delivery re the 14 days which
expires on 17th August. Deemed date of service is the 4th August
so day 1 starts from here.
It is essential that you keep any eye on this date because if it
raises before then it makes your case stronger.
I am happy to assist at the Tribunal BUT please watch the
website regularly. I won a case on this a few months ago v
Southwark.

Hi - to clarify the date of service they share is the date the
letter was delivered.
So I need to keep an eye on the Redbridge PCN website? To check
if pcn fee raises before this time? Is that what I need to keep
an eye out for? Sorry just want to make sure
Is it also worth going back to Redbridge to clarify, for
avoidance of doubt and their assumption I was driving. Explain
to them my husband was driving, I can provide a witness
statement if needed.

Who was driving is totally irrelevant, because the owner has
responsibility in the legislation for all PCNs, whether driving
or not.

the rejection reads (in my interpretation) due to the fact they
think I was driving are not taking the c section and symptom
into consideration fully as they think I was driving

Both of us drive the car. I even had follow up appointments on
my surgery wound, I didn’t articulate the appeal clearly hence
they thought or assumed I drove
I checked the website the penalty is still 80

I passed the main road again and there are signs facing ahead of
me before I make the right turn
Therefore this may be adequate signage?
The pcn has not increased since 17/08 and now 20/08
Is it worth explaining to LA partner driving
