Hi all. Please can someone advise and offer some support.
For background, I have a vehicle through a work scheme with
Tusker. This PCN was issued on 22/07/2026 with the date of
contravention on the 08/07/2026. I do remember going near this
area but cannot remember any signange.
I received an email on 30/07/2026 from Tusker forwarding me the
details and confirming the payment has already been made of £80
plus £10 admin fee. Please see below:
"Dear Customer,
We are writing to let you know that we have received a
notification for your Tusker vehicle RE26EBZ.
Reference: MT0358457A
Date/Time: 08/07/2026 07:45:00
Authority/Operator Name: London Borough of Merton
Document Type: PCN - Moving Traffic (CCTV)
Estimated Cost: £80.00
We have paid this for one of the following reasons:
We have been instructed to pay on your behalf by your employer,
as detailed in your Driver Guide.
Legislation requires payment by the registered keeper, for
example fines issued under the Railway Byelaws.
The notification has been escalated back to Tusker, or we have
received a second notice of a previous fine.
We are unable to transfer liability, and so payment is the only
option available to us.
We have therefore paid £80.00 which your employer will be
deducting from your salary along with a £10 admin fee.
The above payment has been made to avoid escalated costs to both
you and Tusker. It may be possible for you to challenge this
fine, to do so please contact the issuing authority directly.
What do you need to do?
If you accept liability no further action is required.
If you do not accept liability, please appeal to the authority.
You have 28 days, from the time the notice is issued, to do this
and instructions on how to appeal are included on the
notification. To enable you to speak with the authority we have
attached a Third Party Authorisation letter. You will need to
send this with your appeal. If you accept liability no further
action is required.
To submit a challenge, we would advise you to try this online in
the first instance. Where this isn’t accepted due to a payment
being made, you may still appeal in writing by following the
address. If you accept liability no further action is required.
Please be advised, there are only a few reasons why a PCN served
for breaching road rules would be cancelled, such as a medical
emergency or moving out of the way of an emergency vehicle.
If your challenge is successful, please let us know so that we
can locate the refund when it arrives and issue this back to
your employer.

They have provided me a letter of authrosiation which I have
attached as an image along with the PCN.
My issue now is I am unable to view the evidence or challenge
this online. All methods I have tried say once the penalty
notice has been paid, I have lost my right to appeal. I have
sent an email this morning to parking services at merton stating
this and awaiting a response. What should I realistically expect
next? Any advice is greatly appreciated.

Unfortunately nothing with the council; once paid the case is
closed and as they have achieved their aim (getting the money)
they will just shrug their shoulders.
So the only avenue might be with Tusker - that will depend on
what the contract says, and what the PCN says.

This definitely seems insane from Tuskers side to automatically
pay all fines and accept liability whether or not it even
happened.
I appreciate your response and will see if I can contact Tusker
about it and see if theres anything else that can be done.

and recently won several PCNs for a member. We need to see the
contract. They should have written to Merton in the first place.
I can PM you my details as this is outrageous and I would be
threatening them with court - both of them.

The peoblem is I've logged into the dashboard and cannot find a
'driver guide'.
Only thing ive found in all the agreements I've signed is:
"You are responsible for any statutory notices and fines.
You must:
• pay for all parking fines, fees or penalties, speeding fines,
bus lane fines and any other fines issued to you during the term
of the Agreement relating to the Vehicle or your use of the
Vehicle including those which result from motoring offences,
violation or traffic or parking regulations;
• if your vehicle exceeds emission standards, pay any charge if
you drive in a clean air zone
• pay the London congestion charge if you enter the appropriate
zone; and
• inform the insurance provider of any penalty points issued to
you or any of your named drivers, which may result in a review
of your premium, as failure to do so may result in your
insurance cover being invalidated. If you do not pay these
amounts then Tusker will pay them on your behalf and we will
recharge this cost to you together with an administration fee of
£10 plus VAT. If, as registered keeper of the vehicle, Tusker
receives notification of any speeding fine or non-payment of a
fixed penalty notice, Tusker will charge an administration fee
of £10 plus VAT for dealing with such notification. For the
avoidance of doubt, these charges will form part of your Salary
Sacrifice Agreement and you agree to these deductions being
taken from your net pay.
If you use the Vehicle contrary to applicable law, you must
reimburse us for any loss that we and/or Tusker suffer."
The problem is I haven't had a chance to view or challenge the
PCN or even pay if I was liable. Do you think this is reasonable
wording to justify what they have done?

1. I have not been served a fresh PCN.
2. I have received two communications: one dated 4th August and
the second one dated 7th August both of which only give me 14
days to make a representation The second one does not constitute
a PCN as it does not contain the mandatory information it
should.
3. The original PCN does not particularise which vehicles and is
therefore invalid. A PCN is required to state the grounds on
which the enforcement authority believes that the penalty charge
is payable. Those grounds must be expressed in terms that allow
the recipient of the PCN to properly understand the nature of
the alleged contravention. The evidence is that there is a
signed prohibition on motor vehicles. This is not, however,
clear on the face of the PCN which states simply that the
vehicle failed to comply with a prohibition on certain types of
vehicle. A motorist reading the PCN would not understand from
the wording the exact nature of the alleged prohibition. The PCN
needs to explain, whether by wording or images, exactly what the
prohibition is.
3. There is insufficient warning signage in advance of the
terminal signage as far as I recall.
4. My representative is fully aware that your website for such a
contravention includes wrong grounds pertaining to parking
legislation. He has evidence of this. pertaining, as fate would
have it, pertaining to an alleged contravention at the same
location.
5. Due statutory process has not been followed.
In light of the above, please cancel this PCN by reimbursing the
lessor.
