Could the OP please post the full response from PDNP with regard
to their admission that it was a Parking Charge Notice?

Your initial 'appeal' pl.
May I suggest and with respect that we look at this against the
legislative backdrop which is stated i.e. byelaws, and not try
and shoe-horn this into one of our normal categories of parking
charge or penalty charge.
Neither applies IMO.
It's a breach of byelaws.

'Any person'...' 'Authority's conditions for the time being

Pl stop playing their game. Ask them by what authority they are
demanding a specified sum as opposed to them taking action
against the 'person' in accordance with the byelaws.
IMO, what the apparatchiks have done (perhaps, I haven't seen
the 'conditions displayed') is to circumvent the prescribed
process, and commit an offence themselves, by including in these
'conditions' matters which are properly the preserve of the
byelaws and the byelaw making process.

Says it all IMO. As I read the byelaws, there's no such beast:
breach = liability to prosecution.

Agree 100%.
But, as we were trying to work out, how have they turned a
byelaw breach into what is technically a legal breach of
contract (which is what a Parking Charge Notice is)? Answer:
there is no way they can do that.
The other alternative is that their 'parking charge' is simply
an offer of out of court settlement thus avoiding a
'prosecution' under said byelaws. However, if that is the case,
then it must be labelled as such.
The notice, as they have sent it, is extremely misleading in
that respect - suggesting that a 'parking charge' is owed when
no debt can possibly exist.
So, somewhere, they have clearly misused the KODOE (DVLA) system
to obtain the keeper's details - maybe they can access the data
legitimately as an authority but that does not allow them to
then generate Parking Charge Notice - the DVLA data can only be
used for the direct purposes of the byelaw breach (ie
Magistrates Court). They cannot obtain the data under one guise
and then 'switch tracks' which appears to be how their 'system'
works.

OP, if you are the registered keeper then, as their letter says,
'please wait for a further letter'.
IMO, rise above the minutiae pl, don't feel that everything they
write must be countered, it doesn't. While you're waiting for
this 'further letter', do you have photos or GSV of the signs at
the site?

I've only got the pic of the sign I attached in the original
post. Not sure what GSV is though?
