       Redbridge PCN 46n – stopped for around 20 seconds on Cranbrook

       I received a Redbridge PCN for contravention 46n, “stopped where
       prohibited on a red route or clearway”, at 18:53 on Cranbrook
       Road, Ilford, just outside Ilford station.
       I pulled into the area shown in the attached photographs
       because, from the road layout, it initially appeared to be
       somewhere passenger collection might be permitted. I stopped
       only very briefly for about 20sec. Once I had a chance to look
       at the sign and noticed the red-route restriction, I immediately
       pulled away. Based on the CCTV timestamps, I believe the vehicle
       was stationary for only around 20 seconds.
       Based on the PCN, signage and very short stop, is there any
       realistic case to contest this, or is the general view that I
       should pay the discounted amount? I have not yet submitted
       representations.
       I can't seem to find an option to attach the PCN or the pic of
       the signage

       Your narrative has a failry good appeal argument, because the
       video shows the sign is twisted round so it cannot be read from
       your direction of travel, so pulling in an reading the sign,
       finding it doesn't allow parking at the time you pulled in, and
       then you driving off, is a reasonable case.
       However, be aware that London councils and also TfL, game the
       system ruthlessly by rejecting virtually all representations,
       and then re-offer the discount. They do this because they know
       that most people then just cough-up, not being confident of
       knowing motoring law sufficiently to win a the tribunal, and
       also thinking it will cost them a packet. The plain fact is that
       at an adjudication, the full PCN penalty is in play, but there
       are no additional costs at all, and if you win you pay nothing.
       So submit reps based on your narrative and point out you could
       not read the sign until you stopped due to it being twisted
       round as their video shows.

       This seems to be an up-and-coming PCN ‘hot spot’. I believe the
       signs are double-sided at this location. Nevertheless, IMO the
       signs do not comply with the TSRGD because they incorporate
       loading and taxis is the same panel. The road markings are also
       questionable. For example, IMO the white broken line should be
       red (TSRGD: S7-4-6 and S7-5-5).

       If the signs are double-sided, the side for the OP's approach
       would also be unreadable too, as it is twisted round. They can't
       deny their own video, but no doubt will say the sign is OK in
       their usual mendacious manner.

       You could also mention that you pulled out at the first
       opportunity as soon as passing traffic had cleared.

       Redbridge is I think the only London council that has its own
       red route (everywhere else is TFL).
       I can't see how they can mark a bay with double red lines and
       allow some exempted waiting.
       Your stop is too long to just check the sign - why did you stop
       and how do you account for what you were doing during the entire
       stop?

       Pl post the PCN and leave in everything except your personal
       details.
       IMO, the clip shows traffic stationary at a set of lights with
       the OP's car first in line. The traffic queued behind them. They
       then pulled into the area and stopped after 19 seconds. They
       were then passed by 7 vehicles, including a bus. In addition, a
       pedestrian walked the entire length of their car in the
       carriageway on the driver's side not only preventing the car
       moving but IMO posing an unknown threat(at this point if I was
       driving I'd have been more concerned that my car doors were
       locked than anything else). The OP pulled out as soon as the
       pedestrian and vehicle traffic allowed.

       Do you think those points are strong enough to form a proper
       appeal, rather than just a request for discretion? Also, would
       you suggest challenging on both the signage and road markings,
       with reference to TSRGD S7-4-6 and S7-5-5?

       Fair point. I pulled in because the sign was twisted and could
       not be read clearly from my direction of travel. Once I was
       closer the restriction was more visible realised it did not
       permit me to stop at that time. Tincombe has helpfully observed
       from the footage, traffic was stationary at the lights with my
       car first in the queue. I then pulled into the area and stopped.
       During that time, several vehicles, including a bus, passed on
       my right, and a pedestrian walked alongside the driver’s side of
       my car in the carriageway. I pulled out as soon as the
       pedestrian had cleared and there was a safe gap in the traffic.
       No passenger boarded or alighted, and I was not waiting there
       once I understood the restriction.

       IMO, there is no contravention if a driver pulls in to read
       signs which otherwise, because of their orientation, are not
       readable from a moving vehicle in a busy traffic lane.
       You pulled in and left as soon as practically possible after
       realising that you could not avail yourself of the exception.
       The road marking car crashes i.e. the presence of DRL and white
       (instead of red) lines are the icing on the cake IMO.
