       Euro Car Parks PCN – No valid pay& display or permit –
       Cornhill, Wolverhampton

       On the 18th July 2026 the driver pulled up near Wolverhampton
       station at 'Cornhill', they realised they were in the wrong
       place and moved on after stopping for ~10 minutes and 53
       seconds. The PCN below was received today from Euro Car Parks.
       Any help with an appeal or next steps would be greatly
       appreciated. Unfortunately I haven't had chance to head back and
       get photos of any signs yet.

       Signage is irrelevant.
       This can be defended with an appeal to the operator (made as
       keeper) on two clear grounds;
       1. The driver entered the car park, examined signage, was unable
       to make payment so left - so no contract was formed. Reference
       the recent 'open letter' from the CMA to parking operators
       regarding 'consideration period'.
       2. The notice is not POFA complaint so liability can never be
       passed from the unknown driver onto the keeper.

       Hi InterCity125, thanks for you reply, very much appreciate it.
       Will appeal on those grounds today.
       I've done some research, is this correct? The NTK was issues on
       the 23/07, so it is classed as received the day after the second
       day after it was posted, which would be Tuesday 28/07. So 28
       days after this would be 24/08, not 20/08 as stated in the NTK?
       I also not a failure to state the period of parking, just the
       time between ANPR detections.
       Are these both ok to mention?

       I would not go into the specifics of POFA at this stage.
       Focus on the consideration period angle.

       Deemed received 27/7 if issued 23/7,

       But 28 days after this is still 24/8.
       But best to leave out the nitty-gritty for now.
       The ANPR thing is true, but the contrary argument will be that
       the "consideration period" and then the "grace period" (in the
       latter case only if parking is paid for) are designed around
       this.

       <p>Thanks all for the advice, I made an appeal based on the
       consideration time, and referred and linked to the CMA open
       letter. Also mentioned that the notice was not POFA compliant,
       can link to the appeal if needed.</p></br>
       <p>As expected, the appeal was denied and a POPLA code issued.
       I've started writing an appeal, would appreciate some advice on
       the main points to press with POPLA. Thanks</p></br>
