Hi , I stated in a previous post that I was away and
unfortunately don’t have access to the NTK until I arrive back
in the UK. Unfortunately this falls outside the appeal
period😞
So how do you suggest I respond?
As vaguely as possible and quoting POFA as above?
As it’s been widely stated that they will respond as everybody
expects.
Just clarifying before I continue

You should take all the advice offered here, and if there's a
different perspective that at least gives you an alternative
approach.
My view is that these parking companies lie and reject valid
appeals on the basis of "not relevant land" and the IAS sides
with them, so you just go through the process and let them take
you to court, submit a defence and wait for them to fold.
As a 2xRX8 owner that's my advice to you, but it's not
authoritative and in the end you have to make up your own mind!

The tribunal is fully aware of the status of Gatwick Airport,
don't obscure this with minor detail.
Although the tribunal is fully aware that Gatwick Airport is
subject to statutory control by virtue of the ***** Bylaws made
under the *****, I feel compelled to make the point, none the
less. Please see copy of bylaws enclosed.
As such, no claim can arise against the 'keeper'(para. .....
PoFA refers) and in as much as there is any liability, this
remains with the driver.
The creditor is pursuing me as the keeper and therefore the
tribunal is obliged to dismiss their claim. As regards whether
they have a claim against the driver....etc.
Does it need more?

I'd add a rebuttal of Elliot v Loake before the Assessor gets a
chance to spout that nonsense.

These companies just spout this nonsense as part of their
intimidatory tactics to make people pay up. Quoting a specific
case might appear to give them greater legitimacy, but it’s
irrelevant nonsense.

Yes, the RX8 was nice, but the second one was bought on a 0% PCP
plan which was fair enough, but the amount they wanted after 3
years to own the car was more than it was worth, because it was
being discontinued.
I did once have to call out the RAC to start the car when I
flooded the engine, my mistake, known problem.
After a year or so I bought a Jaguar XFR so from the sublime to
the ridiculous ….. 22mpg in both cases.

The creditor hasn't suggested that the RK was the driver;
If the creditor had reason to believe that the RK was the
driver, then they would NOT have engaged with PoFA at all
because its SOLE purpose is to allow the keeper to be held
liable WHEN THE IDENTITY AND CONTACT DETAILS OF THE DRIVER are
not known, FFS the creditor wrote to the keeper by name, so they
know name and address.
IMO, I wouldn't go near attempting to discredit something which
at present the creditor has not even raised.
Keep focused.
