Hi everyone, unfortunately this is the 1st out of my 2 PCNs
that I will be uploading today. I was caught on camera inside
the yellow Junction box, the reason my car is slightly angled is
because I realised I was in the wrong lane very late, hence I
had no choice but to switch lanes, if I had stayed in that lane
it would have forced me to turn right. I was under the
impression the bus was moving hence I moved into the lane. If
anyone can help I would be grateful, currently unemployed so
this has come at the worst time.

I've managed to view the video on Hillingdon's website. I think
there's a reasonable argument there's no contravention
committed.
For there to be a contravention, you have to cause your vehicle
to enter the box junction such that it has to stop within the
box junction due to the presence of stationary vehicles.
You do cause the vehicle to enter the box junction, you do stop,
you do stop due to the presence of vehicles which are
(eventually) stationary. However, I do not think in the
circumstances you had to do so.
When you stop, the bus in front of you is still moving. It
doesn't become stationary until later. When it does stop it is
stationary for around seven seconds. You had the option to start
moving across the box just before it became stationary at a
walking pace (around 3mph). At this speed, in seven seconds you
would have covered around 10 yards. The bus is around 15-20
yards in front of you. Ergo, you had the option to commence
moving and did not have to stop due to the presence of
stationary vehicles.

Agree, but OP needs to be aware that this argument will only get
played out at London Tribunals, with the full PCN penalty in
play.

The PCN is pants. They cannot serve a charge certificate 28 days
from the date of the notice. Hang on OP please.

+1. They just don't seem to get this.
IMO, it's analogous to Clean Air Zone legislation:
May the authority recover the clean air charge? Yes.
May this be demanded with a PCN? No.
As with this:
Is the owner liable for a surcharged penalty as soon as the
28-day period(from date of notice) has elapsed? Yes.
May the council serve a CC as soon as liability arises? No. They
have to wait until the representations period has elapsed, 28
days beginning on date of service. But they will insist on
conflating the two.
If my simplistic analogy is wrong, I hope Hiipocrates will
correct me.

1. The contravention did not occur as the vehicle in front of me
was not stationary when I stopped.
2. I make this collateral challenge regarding the issue of a
charge certificate which cannot happen 28 days from the date of
the PCN.
In light of the above please cancel.
