PCN challenge London Borought of Hammersmith & Fulham

I received a PCN (Code 21s) from Hammersmith & Fulham for
parking in a suspended bay in Pennard Road.
The suspension covered Nos. 5–19 Lanark Mansions. There was only
one suspension sign, and I approached from the opposite end of
the bay.
In my informal challenge I requested:
the suspension authorisation;
the suspension log;
confirmation of when the suspension sign was erected; and
photographs showing all suspension signage.
The council rejected my challenge and did not provide any of
those documents. Instead, they directed me to submit a Freedom
of Information request while asserting that the sign had been
erected before the suspension and that the signage was adequate.
Is it correct that the council should disclose the evidence it
relies upon during the enforcement process rather than requiring
an FOI request? Also, does anyone know of any ETA decisions
concerning suspended bays where only one suspension sign was
used for a long section of parking bay?

Thank you for writing to us about the above Penalty Charge
Notice (PCN).
Why the PCN was issued?
The PCN was issued because the vehicle was parked in a suspended
parking bay during
controlled hours.
Your challenge
You have stated that:
On 23 June 2026, I parked my motorcycle in Pennard Road. I
entered the bay from the
end opposite to where the suspension sign was located. The
suspension covered a
lengthy section of parking bay outside Nos. 5 to 19 Lanark
Mansions, yet only one
suspension sign appears to have been displayed. There was no
suspension sign
positioned at the opposite end of the suspended section to alert
motorists approaching
from that direction, nor was there any sign located near the
point where I entered the bay.
In my view, the suspension was not adequately signed given the
length of the suspended
area and the reliance on a single sign. Having reviewed the
council photographs, I note
that the suspension related to a substantial stretch of bay. Had
additional signs been
placed at both ends of the suspended section, the restriction
would have been much
clearer to motorists approaching from either direction. I
respectfully request that the
Council exercise its discretion and cancel the PCN in the
circumstances.If the Council is not minded to cancel the PCN, I
would be grateful if you could provide:
1. A copy of the suspension authorisation.
2. Confirmation of the date and time the suspension sign was
erected.
3. The suspension log and any records relating to the
installation of the suspension
signage.
4. Photographs showing all signage used to indicate the
suspended section.
I am a responsible motorist and would not knowingly park in a
suspended bay. I
respectfully ask the Council to give careful consideration to
this challenge and to cancel
the PCN.
My findings
Council officers can suspend the use of parking bays for reasons
such as:
• to provide access for people moving house
• to provide access for utility companies who need to do street
works
• to provide access for Council contractors (drain clearing,
tree pruning, etc)
• to provide access for funeral cars
When we suspend parking, we place yellow warning signs in the
area at least seven days
in advance, these warn motorists that a suspension is (or will
be) in force. No vehicle may
park in a suspended area while the suspension is in force,
unless the space was
suspended for that particular vehicle.
I note your comment regarding the positioning of the signage and
the the suspension was
not adequately signed given the length of the suspended area.
The relevant regulations
require clear and adequate signage to notify drivers of any
suspension. In this case, the
suspension notice was installed at the location prior to the
date of suspension and was
visible on the day the vehicle was parked in contravention. The
suspension signage clearly
indicated the extent of the suspended area and the dates and
times the suspension was in
effect.
I acknowledge your request for a copy of the suspension
authorisation, confirmation of the
date and time the suspension sign was erected, the suspension
log and any records
relating to the installation of the suspension signage and
photographs showing all signage
used to indicate the suspended section. You would need to submit
a Freedom of
Information (FoI) request using the below link:

The Civil Enforcement Officer’s (CEO) notes state that;
following a period of 7 minutes
observation, over which no activity involving the vehicle was
seen, the PCN was issued.
Drivers have the responsibility of checking signs and markings,
and must act in
accordance with them. I am therefore satisfied that the PCN was
correctly issued.
My decision
I have considered what you have said and all the available
evidence, but I do not agree
that we should cancel your liability for this PCN.What happens
next
Your options are detailed below.
If you wish to pay at the discounted rate of £80.00, you may
still do so, provided we
receive your £80.00 payment within 14 days of the date of this
letter. THIS OFFER WILL
NOT BE REPEATED. Once these 14 days have expired, the full
charge of £160.00 will
become due.

How to take the case further:
1 If you do not pay, we will send a `Notice to Owner` to the
keeper. This form offers the
keeper the chance to formally challenge the PCN, or to pay the
full charge (by this time it
will be too late to take advantage of the discount). If you are
not the registered keeper, let
them know what you decide to do and that a Notice to Owner will
be issued to them in due
course.
2 If we still disagree with you, the keeper can take the case to
the Environment and Traffic
Adjudicators; they are independent and their decision is binding
on both sides.

It doesn't look good from your photos because the suspension
sign is only a few yards away from where you parked. Did you not
see it ?
In your favour is that it seems the suspension sign was not
mounted on the sign for the bay. There is no requirement to look
for a suspension sign, but when parking in a marked bay there is
a duty to look for the bay sign to see if you can park at the
time you arrived, or have to pay.

Just to clarify the layout. I was parked outside No. 11.
Opposite me are the shared entrances for Nos. 6/8 and 10/12. The
nearest parking place sign is between those entrances and is
effectively opposite where I parked. That sign did not have the
yellow suspension notice attached. The suspension notice was
instead fixed to a street-light column approximately 7 metres
away towards the junction. Is that something an adjudicator
might consider when deciding whether the suspension was
adequately signed?

Signs on the opposite side of the road to where you parked do
not apply to your bay.

Thank you. You're absolutely right, I hadn't appreciated that
the parking sign on the opposite side of the road doesn't apply
to my bay.
My remaining concern is that the council refused to provide the
suspension authorisation, suspension log or installation records
when I requested them, instead directing me to make an FOI
request. If this goes to formal representations or tribunal,
should they be disclosing the evidence they rely upon rather
than requiring an FOI request?
Also, has anyone come across any ETA decisions where a single
suspension sign was considered inadequate for a suspension
extending from Nos. 5 to 19?

They have to produce an evidence pack which provides details on
the suspension. If you query the notice they will provide the
log which will include when it was erected.
Main point to emphasise in your representations is a suspension
sign was not erected on the sign for the bay. This is a fatal
error, because you came past it and saw no suspension sign, and
then parked your scooter. With nothing on the bay sign to
indicate a suspension, you were entitled to park in accordance
with the restrictions shown on the bay sign.
