Hello all
I sold my car in may 2023 , the following day the dealer drove
it through the tyne tunnel
I recieved a PCN through post however I assumed wrongly I was
not the keeper on the Dvla site ,
The dealer did not actually notify the DVLa of sale I was
unaware I ignored all letters
A year later i moved house
1 yesr later my bank informed me of a CCJ issued by default at
Birmingham
I contacted the DVLa and have a letter confirming I was NOT the
keeper , I have conveyancing proof i did not live in house where
court papers sent to
Ive paid £282 to the tyne tunnel and £330 court fees my hearing
is shortly happening
Moorside legal rang today and offered to not dispute the CCj of
they could keep my money , they said i dont have a case
Any advice appreciated I assumed I was not liable for the
journey and the negligent serving of court papers appreciate any
advice

Tyne Tunnel is a peculiarity and not many people are up-to-speed
on it on this forum, I'm afraid. Hopefully somebody will be
along soon to help you who knows about it. It operates under a
local by-law, with no overriding national legislation.
Anyway, you can 'mug-up' on them here: -

I'm not sure how you got a CCJ, because as far as I know, not
paying the toll is a criminal matter.

It's your obligation to notify DVLA as well as the buyer.
I would advise researching your obligations on the DVLA website
because you might be asked why you didn't notify DVLA and why
you ignored the TT Notice.
Also, look at why Moorside did not discover your actual address
for service of their claim.
But do you want to get to court armed with questions or answers?
Ive paid £282 to the tyne tunnel and £330 court fees my hearing
is shortly happening Can you elaborate?
