TFL CODE 46 EMERGENCY STOP BRIEFLY OUTSIDE LOADING HOURS ON RED

On 27 May 2026, I made an emergency stop to secure a load on my
motorcycle (load that was falling off). I stopped in a Loading
area outside 409 - 411 Holloway Road N7, at 09.45. Loading is
allowed from 10.00.
I received the attached PCN on 9 June 2026 and I immediately
wrote an appeal on the Online Service on the TFL website. I
explained that I stopped (for one minute and 14 seconds - from
09.43.49 to 09.45.03 according to TFL's images) as an emergency
as the load on my motorcycle was dangerously loose and I said
that it would have been a danger to myself and other road users
if I had continued my journey.
I received no email or other confirmation of my appeal and so
after a few days, I called TFL's Penalty Charge Appeal Line on
0343 222 3333 on 11th and 12th June 2026; on the 12th of June
2026, I spoke with a man for 4 minutes, he checked my file and
assured me that my appeal had been received and I would be
notified of the outcome by email or letter.
Since this telephone conversation, I have received no emails,
letters or any other contact from TFL until I received the
attached Charge Certificate.
I would have taken the opportunity to appear before an
adjudicator (if my appeal was refused, which it appears it was)
but I have not been given that opportunity.
I have NOT responded to the Charge Certificate.
Here is the Status History, I received no 'Representation
Receipted' email on or around 9 June and they do not seem to
have a record of informing me of rejecting my representation?

First thing to say is DO NOT PAY the CC. What you do now is wait
for TfL to register the debt at the Traffic Enforcement Centre.
They then must send you an Order for Recovery letter. You can
then submit a Statutory Declaration that you submitted reps but
did not receive a letter rejecting those reps. TEC will then
order the OfR and CC to be cancelled, and the matter reverts to
when you submitted the reps. The regulations are that TfL must
pass the matter to the adjudicators for a decision on what to
do.
London Tribunals have issued a Practice Direction to councils
and Tfl regarding action to take when TEC cancel a CC and OfR: -

It would be prudent for you, once the period for payment of the
CC has expired, to check with TEC every 7-10 days to see if your
PCN has been registered. Alternatively, you can check on the TfL
website to see what amount is owing, and when this increases by
£10, (the TEC registration fee), you know it has been
registered. This covers it going astray in the post. You don't
have to wait for receipt of the OfR, you can download the
relevant form for the SD from the TEC website. The form is PE3

hence - gets you to the adjudicator.

Emails from TfL often don't arrive. They have not proved actual
sending when put to proof. One they sent to me went into spam
but luckily I spotted it
