If you examine the camera plan from the bundle you'll see that
there are cameras at the 'boulevard entrance' and then further
cameras covering the longer stay car park.
They obviously use the different cameras to work out where they
'think' drivers are parking?
Does that make sense?
But there's no fail safe - if a vehicle enters the main entrance
(and is not detected by any other camera) and stays onsite for
longer than a certain time then the operator simply assumes that
the vehicle is parked in the 'drop off' car park.
Does that make sense?
It's all based on assumption.
Is there any timesheets which cover the longer stay car park?

Yes it all makes sense. Attached is photo of where the anpr
cameras are in the long stay car park. The vehicle was parked
just behind the no entry sign to the right of it.
No further time sheets sent to me only 20+ pages of what I’ve
already sent you. I did ask for cctv footage of where the car
was parked but nothing was forthcoming and I understand it’s
wiped after 30 days.
Surely the anpr cameras in the car park should have picked the
vehicle up entering and leaving? Do the cameras even work?

So now we understand what has happened and how their system
works, i.e. there are separate cameras at the actual car park
entrances which should pick up reg plates and allocate them to
the carpark. This appears not to have happened for some reason
for your car so they have inferred it stayed in the drop off.
If you still have the ticket with your reg on you should have a
decent case - they have failed to include the logs of the other
carparks over the relevant time, so how do we know they were
working at all? Looks like a response outlining the above, that
you bought a ticket and had to manually the reg number, and that
the fault is with their ANPR equipment ought to have a decent
chance - but don't be too disheartened if not!

I can come up with comments on the operators evidence.
Remember that we are not identifying the driver.
They have not dealt with the non complaint POFA issue and their
comments on CP Plus and GroupNexus are legally illiterate.

As you have very kindly helped me this far, could you please
help me come up with a reply to the operators evidence. I can
obviously include that they haven’t answered the comments
regarding non compliance and the company names being confusing
but I don’t know what else to write without going over old
ground or missing the point entirely.
I have a feeling POPLA will overlook the non compliance and
company names with no further chance to raise.

I would reply something along the lines of:
Referring to my original points of appeal:
Point 1:
It is now apparent that this PCN has arisen due to a failure of
Group Nexus / CP Plus's equipment on site. Their camera map
shows that there are secondary cameras on the entrance to the
various car parks, and these should pick up cars entering these
car parks, and then cancel them from the list of cars entering
the site (and therefore using the drop off zone), and make the
reg numbers available in the payment machine. For reasons
unknown this has not happened on this occasion, and my vehicle
has not been picked up on the secondary cameras - although CPP
have not submitted any logs to show the secondary cameras were
actually in operation / functioning at the time and that my
vehicle was not logged on these cameras. This would appear to
be why the driver was not able to find the registration on the
parking machine and had to manually enter it.
I maintain that:
The vehicle was parked in XX carpark from shortly after the time
shown on CPPs main entry log till shortly before the time shown
on the exit log
The driver purchased a ticket for the time parked (see attached)
CPP's ANPR system was at fault and did not log the vehicle
entering and / or exiting XX carpark (this has not been
demonstrated since CPP has not submitted the ANPR logs for this
carpark)
No further charges are due, the vehicle not having been parked
in the drop off as alleged, and the appropriate parking fee was
paid.
Points 2 - 4:
Notwithstanding the above, CPP have failed to address the
shortcomings in their PCN that invalidate the transfer of
liability to me as keeper.
You will need to put in the name of the carpark, and maybe the
timings?

Thank you Richard for your help. I do have the ticket still and
will send them a copy. I will also send them a copy of the
appointment text for my mother. Why would the car be parked in
the drop off zone if it arrived at 1.30pm and the appointment
wasn’t until 2.15pm?
No doubt I will be back for further assistance when the appeal
to POPLA is rejected. I don’t see many appeals being successful
:(

POPLA have a better record than IAS, and CPP have shot
themselves in the foot by not submitting the secondary logs. I
still wouldn't like to second guess the outcome however!
