       Unfortunately I didn’t have a copy of the appeal as it was done
       online. As it seemed they were saying a  a parking fee hadn’t
       been paid (and there was no mention of parking in the drop off
       zone) I explained about the machine not recognising the
       registration number even though it was keyed in correctly (the
       driver checked) and it was the second time that week that had
       happened albeit with a different machine. I sent them a copy of
       the receipt following cash payment of the fee of £3.80 and it
       shows the registration number of the vehicle too. I thought that
       would be it, simple, as it showed the correct amount had been
       paid. The car was parked in the carpark at 1.30pm ( site entered
       at 13.26pm) and left at 14.36pm. So even for the 4 minutes not
       counted the driver was still well within the time limit for that
       fee.
       The first mention of the drop off zone is when the email
       rejecting the appeal came through. See first post.
       I have absolutely no idea why they think the car was in the drop
       off zone which is why I feel so very strongly about not paying
       their invoice. Were other people caught that day in the same
       way? I guess I’ll never know.
       The hospital has not been approached and I suspect they will
       only refer back to the parking company and will not want to get
       involved even though as you say, they are jointly responsible. I
       can try to give them a call but I won’t hold my breath.

       You should at least talk to PALS, if this exists at the
       hospital.

       I spoke to the hospital who just referred me to their third
       party parking company - Group Nexus. Pals weren’t answering
       their phones so may have to email them. Reading their blurb it
       doesn’t appear parking is within their remit.
       However, I spoke to the hospital security company to see if they
       have cctv on the main entrance. They do, hopefully it will cover
       the drop off zone too. I have asked them to either send cctv
       images showing I wasn’t there between the times Group Nexus said
       I was or an email confirming I wasn’t.

       Good morning,
       Unsurprisingly, no CCTV or email forthcoming from security at
       Russell’s Hall Hospital.
       So my question is do I stand a good chance of winning an appeal
       with POPLA ( it seems from reviews that there are very few
       successes), do I suck it up and pay the £40 invoice, extremely
       begrudgingly bearing in mind they are getting the money under
       false pretences or, let it go to court?
       It seems it is their word against mine.

       I would not pay this under any circumstance.
       Have you tried PALS at the hospital?

       Thank you for replying.
       I have emailed PALS but they take 5 working days to respond and
       if I’m going to pay £40 ie reduced invoice (goes to £80 if
       appeal refused by POPLA) I have to pay it tomorrow at latest. I
       really can’t afford to waste money and I feel as if I’m being
       forced into paying it as POPLA appeals success rate not good.
       If I don’t pay,  I’m guessing I wait for response from PALS and
       then appeal to POPLA and if still rejected, wait for court
       summons? :-\
       As there will be no photos/ footage of the car parked in the
       drop off zone, how can the car parking company be successful?
       Surely they have to prove I was there rather than just
       entering/exiting the site?
       I really appreciate the help I’ve been given so far.

       Yes it did:
       'Location'
       Russells Hall Hospital Drop Off'
       Their ONLY evidence as to the location is the photos.
       Do these show on the balance of probabilities that you entered
       and stopped in the 'Drop-off' zone? If not, then IMO absolutely
       carry on.
       A POPLA assessor's first consideration is whether a parking
       charge is owed, to determine which they need evidence.
       Theirs is the photos and copies of the signs at the location and
       the Ts and Cs of parking. But the latter aren't the issue.
       Substantially, it would appear that the photos do not prove that
       you were parked in the Drop-Off zone unless these are from
       cameras which cover ONLY the drop off zone and there is no other
       exit from that zone.
       Circumstantially, you have payment of the correct fee for
       parking in the general carpark area. On this point, I refer to
       this comment in (what you've posted of) their response:
       the drop-off car parking space has a 15-minute time limit, and
       payment is not permitted.
       Which suggests that payment facilities are not provided.
       So, what are they saying....that you drove in, parked for the
       stated time, exited the car park to find a payment machine
       elsewhere, paid, returned to you car and then left. Or perhaps
       exited past the camera, returned on foot to pay then left?
       The more you think about it, the more preposterous it sounds!
       Anyway, pl post their actual response and confirm the details of
       the drop- off point - apologies if this is embedded in other
       responses.
       I agree with others, carry on. But it's your choice.
