Hi, I am hoping you can help me.
I as the registered keeper have received a parking invoice from
Group Nexus stating the driver overstayed the maximum stay. They
did not! They were taking their 87year old mother to the
hospital, they parked in the main carpark, went to the
appointment and then went to the machines to pay for the
parking. They entered the registration number, which the machine
did not recognise, they checked it was correct, it was so had to
enter manually, trying to remember the time they arrived. They
were 4 minutes out, they checked the clock in the car at 1.30
when they parked up but forgot to allow themself time from when
the anpr camperas clocked them entering the site. The parking
fee of £3.80 was paid for the time of 13.30 to 14.36.
This was the second time that week that their cameras didn’t
pick up the registration number (no parking ticket received for
that visit, again had to manually enter details).
I obviously appealed the invoice (before I discovered your
website) and received an email back stating:
Thank you for your correspondence relating to your Parking
Charge: *************
The Charge was issued and the signage is displayed in compliance
with The Private Parking Sector Single Code of Practice and all
relevant laws and regulations.
Clear signs at the entrance of this site and throughout inform
drivers that the drop-off car parking space has a 15-minute time
limit, and payment is not permitted. Your representations are
not considered a mitigating circumstance for appeal.
In light of this, on this occasion, your representations have
been carefully considered and rejected.
They did not park in the drop off zone which I gather is in the
red zone outside the main hospital entrance. They parked in the
main carpark (and have always done so on numerous visits
before).You can see the entrance where the white car is coming
out of which is before the red zone, assuming this is the drop
off zone.
My only options now are to pay the £40invoice which I 100%
object to or appeal to POPLA which I understand which I
understand no one seems to have much success with
I have attached photos of the letter (offence appears to be
different than the offence in the email which means my appeal
was never going to be successful, together with photos of the
entrance to the car park. Link

The notice appears to indicate that the vehicle was parked in
the drop off area rather than the car park?
Was the driver revealed in your appeal?
The NtK is not POFA compliant.

The vehicle was not parked in the drop off zone, it was parked
in the main car park as it always is when my mother has a
hospital appointment. They have not sent any photos of being
incorrectly parked as there are none. The only photos are of the
vehicle entering and leaving the site which would apply to every
vehicle visiting the hospital. There is only one entrance to the
hospital for the public to park apart from A & E.
The original letter did not state the vehicle was parked in the
drop off zone but that it had exceeded the maximum time limit of
15 mins. I appealed stating that the driver had paid for the
time they were there for my mother’s appointment and that their
machine had not registered the reg number when going to pay, as
this is what I thought they were getting at, as there was no
mention of incorrect parking. Unfortunately the driver was
revealed as I had not discovered this website with the advice to
follow. Their letter does state that the registered keeper would
be pursued in the absence of driver details.

Notice to Keeper
Protection of Freedoms Act 2012,

/>specifically Schedule 4 which can be used to transfer
liability
from the (unknown) driver to the registered keeper. Many NtKs do
not comply with the requirements of the legislation, so by
telling them who the driver was they can pursue the driver
directly and PoFA does not enter into it, because it is the
driver who enters into a contract by reading the signs and by
parking, and can be pursued directly for breach of contract.
The NtK statement that the registered keeper will be pursued in
the absence of driver details is often designed to frighten you
into paying or revealing the driver details, often in the form
of a “reasonable assumption that the registered keeper was the
driver”. Essentially they can assume what they like, but the
assumption has no force of law behind it if they don’t comply
with the requirements of PoFA 2012.

I'm trying to find the road location on GSV using the manhole
cover (in the first picture on the PCN) as a reference point.
Any idea?

Yes that is the correct manhole cover. The landrover is leaving
the site, the white car is coming out of the maternity ward
carpark. If you turn the photo 180 degrees, you can see the car
park on the left where the grey car is exiting. The driver
parked where the white car is exiting on the back row adjacent
to the main road. The red zone just after the main carpark
entry/exit is the drop off zone I think. The driver has never
driven down there because there’s never been a need to.
Thanks for confirmation on NtK and POFA.
No other photos I can see on Group Nexus website that apply
here.

What did you say in your appeal - exact words if you have copy?
It appears that their ANPR has picked up / assumed that the car
went into the drop off - but how they do this given the photos
only show the car on the road before the turn into the carpark
is anyone's guess! This might be an occasion where a carefully
crafted POPLA appeal will work. How long does the parking
charge that was paid cover - difficult to read on GSV, but it
looks like £3.80 is 1.5 hours which the stay was less than, even
by the PCN?
Have you also approached the Hospital? They have contracted
this crowd and are jointly responsible for their actions!
